    • LOL. after sending Perch capital a CCA request with a stapled £1 PO attached (x2) Their lapdog Legal team TM Legal have sent me two letters today saying "due to a recent payment on the account, your account is open to legal/enforcement action" so i guess they have tried to apply that payment to the account to run the statue bar along. dirty tactics lol.
    • I have initiated the breathing space so ill wait. from re reading everything this what i understand BS gives me 60 days break from the creditors during these 60 days they may contact me and will most likely default I need to wait until after a default notice to see whether the OC will keep the debt or sell it off If kept by the OC then i should attempt a plan or pay some token payment? If sold to DCA then don't pay and after 6 years it will leave my credit report once the DN is registered with a date. DCA may start a CCJ but unlikely, if they do come back here. last question, do you know roughly how long this will all take? in terms of defaults/default notice, potential CCJ? Would you say I have 12 months plus from when the BS ends?
    • Well, it's up to you. Years & years & years ago the forum used to suggest appealing to POPLA, but then AFAIK POPLA's remit was changed and it became much more biased in favour of the PPCs. One of the problems with taking that route is that the onus will fall on you to prove your appeal, while if you do nothing the onus is on MET to start legal action which experience teaches they are very, very reluctant to do. If you go down the POPLA route I would think your ace would be insufficient signage.  Are you able to go back there and get photos of their rubbish, entrapping signs?
    • The first clearly visible sign as you pull in to the car park states “McDonald’s Customers Only 60 minutes” The next clearly visible sign is an almost identical sign outside Starbucks which states “60 minutes free stay for customers only” There are other signs towards the rear of the car park (away from the outlets) that have the terms and conditions on them in very small print.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well peeps here I go all over again, totally & utterly p***ed off.

I'm in the middle of changing bank, I sent them a letter last week telling them I want everything moved over to my new bank, I have even spoke to a lovely lady on the phone from Abbey, & she confirmed that they have also been in touch with halicraps, informing them of the move over, but they still want to charge me £74 for failed DD's for the massive value of, wait for it............................................................£11.92, it is an absolute & utter joke. I even stuck a tenner in there to go with the £1.98 that was already in there, just to cover payment, & they send me an email at 10.30 last night; so when I signed into my online account I found the dreaded letter. To say that I'm annoyed is mild th_chainsaw.gifBut, there is a possibility that I might be able to get this nipped in the bud, So, I'll keep you all posted.

aaaaaaaaaaaaaaaaaaaaaaaaaaaahhhhhhhhhhhhhhhhhhhhhhhhhhhhhh, now I'm totally climbing the F***ing walls, I spoke to the insurance company, & the young lass on the phone said that as I have offered to pay this month instalment by cheque, she would waive it this month, which means I don't have to pay anything at until Sept. - sorted, no problems at all.

Rang haliprats, & was told that I would have to pay this months instalment, & £74 charges. He would not listen to what I what saying to him, & was adamant that the letter I got telling me that I was getting my money back, had to be signed & sent back, so I read the actual letter out to him. His answer was that if I transfer what is left in my account to Abbey, I would be putting my halicrap one into default, & either way I will have to pay the charges, I told him that I will spend it all before they get anything from me, & I will take it all the way to court again if I had to, I also said that I would have to see what CAG will say about that, as I have been a member for a while now, I then put the phone down & went mad. aaaaaaaaaaaahhhhhhhhhhhhhhangryboese0867yc.gif

What happened was that I thought everything was covered, money DD's & my benefit, all organised & ready to change over to Abbey. My benefit will go in to abbey next week, 'cos I sorted that myself, but I didn't know that the form for DD's has been lost, & thats why the peeps in the account shift office thought I didn't want my DD's moving from halicraps. So now I'm gonna have to ring Margaret at Abbey again & see if anything can be done about that £78, 'cos like I told the young man at halicraps, I have no intention of paying them anything, & if I have to I will spend the £11.98 that is still in there.

I ain't finished yet, I've still got some fight left in me. lol

To cap it all, I've just dropped my mobile into the washing up bowl, & yes it was full of washing up & water.

hehehehehe, I know, but I've had to hang it out to dry. lmao

Just spoke to Margaret again from abbey, glad I'm going there. She said that maybe it would be best to leave the bit of money in halicraps for now, & when I get letter from haliprats by post, to take it in to her & they will maybe pay charges, also ring halicraps again, & ask to speak to a manager & ask for the charges to be waivered, 'cos she said it can be done, & also to get as much advice & info from CAG as I can, to see what I can do about them, 'cos they (halicraps) haven't given me a chance at all. She also told me that they have to give me 14 days notice before they can take any charges from me. Plus as my benefit is just that, is it not "Illegal" (maybe not right word) for banks to take it from my account. Then again it won't be going in there will it. lol

Got headache now. Can't cope today, just found out the pub where the lads go for basketing their Pigeons has closed last night, so I now have to find somewhere else for tonight & get everything out of the pub that belongs to us. Can I go back to bed & start again from the day I got my first lot of money back pleeeeeeeease

Update no. can't remember!

Just this minute got off the phone with a Manager no less, at haliprats, & yep you guessed it they will NOT be waivering the charges, you should have been here , it got into another fairly heated conversation, & would you believe I didn't even raise my voice once (proud of myself there), but I was a tadge sarcastic about how they can justify charging the amount that they do, he told me if I wanted a letter sent to me by post it would cost me £5; I told him to forget it, 'cos there is no way on earth I'm going to pay any more money them a*seholesBIGYuppyAcid.gif

Hi money, yes I have when I spoke to one of their managers, & his reply was, "we can take it, because you owe it to us, & the rules also allow it".

Margaret at Abbey, told me that they will pay the £74 because of the misunderstanding, & it not being my fault, which I can honestly say is very good of them. She advised me to come back on CAG & get as much help & info that I could to try & beat haliprats again, & she agrees that they haven't given me a chance, by slapping the charges back on within a day of missed payment.

Hi money, I've had to print letter I got online, & took it to abbey. Margaret said that they would probably pay the £78 charges, & that haliprats didn't give me a chance.

So, it looks as if this has gone as far as it can. lol

Yesterday I got a phone call from my dad, to let me know that I had a letter from haliprats, basically to tell me that I owe them £66.02, I can't understand how they get that, 'cos the exact amount is £62.02, (but I'll get from mum & dads on tuesday morning when I go over to see them). The daft thing is that I took the copy of the first letter telling me that I hadn't enough to cover my DD payments to the Abbey, 'cos I was told that they would pay the £74 as it was all a misunderstanding on their part, as I told the lady who was organising my new account that I wanted to transfer "everything" over from haliprats to my new account. So, I would assume that it would all be in the process of being sorted out now, but as usual haliprats are being total rats again, & have taken the £11.98 that was in the old account, & sent this one telling me that I owe all over again.

Well there is just one thing I want to say to them, & that is: "If you want any money from me, then you'll have to SUE ME, 'cos you ain't getting so much as a brass button out of me, & I want my £11.98 back", & "I don't care if you are going to close my account (it'll save me a job), 'cos if you hadn't have dragged it out, into a very long process in the first place, by putting all sorts of barriers in the way of ME wanting to close the damned account myself, then it would NOT have got back to this stage for the 2nd time". ooooooooooh it makes my blood boil, they are such F***ing idiots.

tilly, there's a very big chance that I'm gonna get that "dreaded" chainsaw out again, hehehe, & I promise I'll be careful to make sure I chop 'em all up. super_smilies007.gif

This damned stay business is just going too far now, its OK for the banks to stop paying us out, but they still expect us to pay them; so as usual its the little fella who gets stomped on. There doesn't seem to be any justice at the moment. We seem to take one step forward, & 3 steps back. Looks like there could be more than the 2 of us with the chainsaws, super_smilies007.gif

You could try that, & hope they don't cotton on, but knowing them they'll know. Barclay's have been refused a stay, so you never know!! I hope everything goes OK for you though, 'cos there's nothing more annoying than banks ignoring you, no matter how much you plead with them. lol

I actually put it on my PoC & claim form, as there is a part in your claim form where you actually add it to all the money that you are claiming. It isn't returnable from the court. Everyone who goes to court & wins their case, can have all court costs & anything else, paid by the defendants, it is the defendants who pay all court costs & everything that is owed to you.

I hope I have managed to explain this clear enough for you.

Update, went to halibuts yesterday - in an attempt for the 5th time - to close the account, but as usual they wouldn't let me. All they could say to me was "you cannot close this account as its £66.02 in default", so I just snapped & demanded that she gave me the card back, & crossed the road & went into Abbey & asked if there was somebody that I could speak to urgently, & as luck would have it Margaret was able to help me. I gave her the letter telling me that I was in breach & that I must pay £66.02 by the 23 August or have legal proceedings taken against me, or they'll instruct a debt collection agency to recover any amount I owe them.

Now this is where I'm a bit puzzled, I had £11.98 in the account, which they took out, so does that not mean that its £62.02 left owing. Anyhow Margaret said that not to worry, & she came back & we got into the queue & she had arranged for me to go back to halibats with the £66.02. So, they (Abbey) were true to their word. I went back to halibats, & while I was in the queue a girl was asking if they just wanted to pay money in, & would they like to use the machine, she didn't ask me (I think she could see that I was in no mood for machines), anyhow it got to my turn & the lad sorted it out for me to sack 'em, & would you believe; he asked me if there was anything else I would like him to help me with, I just turned round & said "No, I've now managed to do what I have been trying to do for a month & I only want to get out of this place". I think it was full of managers yesterday as well.

So, this saga is now over I hope, & that this does not happen to anyone else.

Yes, I must admit that I am, but it should never have got as far as it did, if halibuts had given folk a chance, no-one would be in this predicament, but unfortunately for us poor peeps, the banks are getting stinking rich, lol. But we must all stick together & get back what's rightly ours.
