      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

What we should all be doing now is complaining to those who have put the obsticle in our path.

 

I'm not very good at composing letters, but what we need is a template letter of complaint that we can send off to the FSA and OFT.

 

The fsa have just put a great big wall between us and the banks and the banks continue to profit while we are out of pocket - it is a disgrace.

Well I have sent my second complaint to the FSA requesting information has to why they ruled that banks get a waiver while at the same time are allowed to continue making these unlawful charges against customers accounts.

 

I also want to know why it is banks haver the right to access my account and take whatever charges they impose without my consent. Not even the government, or any other company have this privilage so why on earth do the banks get it, just because they look after our cash?

 

The banks should be made to send out a bill like any other company, and if the bill isn't paid then the bank should apply for a court oder to retreive the money.

 

THEY SHOULD NOT JUST HAVE THE RIGHT TO TAKE IT!

If it was the case that a bank had to send a customer a bill or obtain a court order before claiming money for a charges then the situation we all find ourselves would never have arisen.

 

The bank would have had to take the individual to court if he/she disputed the charge and it would then be up to a judge to decide if it was a legitimate claim, hence the banks would not be so braisen charging customers with unlawful charges.

Remeber its not just the internet we can use to spread the message, I have been printing off a few leaflets I put together and dropping them on the counters in my bank putting them up in the local library and leaving them near cash machines.

Thanks Mac - I like to do my bit

 

If anyone has any ideas I could use to create a leaflet, then lets hear them.

 

What we need is a something easily distributed on the net and off the net with a message thats to the point and eye catching.

 

Chain letters are a great method for getting a message sent out, chain email would be great, send it to friends asking them to send it on to their friends and so on and so on

I didn't draw the cartoon, but it could easily be removed with a click of a button.

 

It would be nice to have something similar in its place, I will try and produce something similar myself.

Thanks Mac, the cartoon is ok to distribute now since its my own creation.

 

I hope to do another leaflet but with two highwaymen, one the the bank and the other the FSA assisting the bank, mugging one elderly lady. Hope to make a start today. Oh and the FSA will be riding a donky not a horse.

I'm limited on where I can put things without making it too cluttered.

I just had an Idea - that the FSA highway man can carrying a flag and on it I can put what you have suggested in your post.

 

The image says a lot now - the bank on a high horse looking confident, big nose to sniff out the money. We have the FSA highway man on his toothless donkey, looking stupid and useless, with the FSA man holding a joke gun totally unprepared and out of his depth and offering to help the bank not the elderly woman.

 

What I need is a reply from the bank man which makes it a little more clear that its he who the help is being offered.

I know a single mother who withdrew her benifits money from a cash machine in her local shop, however, the machine made a charge of £1 and that took her overdrawn and she was charged £30 by Barclays.

 

£30 must be a very sizable slice of someones benifits, what a gut wrenching situation banks have on peoples lives.

I have been busy posting the leaflet on other forums, and sending it via email to friends and family, to try encorrage others to start complaining about the FSA's outrageous decision to suspend the rights of the consumer from taking action against the banks.

The FSA suspended consumer rights to take action so its the FSA who the complaints should be directed towards and MP's since the FSA was setup by the government.

Complaints about the FSA

 

 

 

We have a formal complaints scheme to deal with any complaint against the FSA. You can use this to complain about the way we have carried out, or failed to carry out, any of our functions. We will then investigate your complaint.

 

We can investigate your complaint if it:

 

  • amounts to an expression of dissatisfaction;
  • is directed against us, the FSA, rather than against any other organisation or firm, whether we regulate them or not; or
  • is about the way we have carried out, or failed to carry out, our functions, other than the things we have to do by law.

We cannot investigate complaints about:

 

  • our relationship with our employees;
  • contractual or commercial disputes involving the FSA;
  • our making of rules, issuing of codes and general guidance; or
  • the actions, or inactions, of the Financial Ombudsman Service or the Financial Services Compensation Scheme.

We will not investigate complaints that:

 

  • could or would be more appropriately dealt with in another way (eg at a Tribunal or through the courts);
  • are connected to, or are the subject of, ongoing FSA action; or
  • express no more than dissatisfaction with our general policies or the exercise of, or failure to exercise, our discretion where no misconduct is alleged.

It does seem very important that we are complaining about the FSA's decision to suspend consumers right to take action in the courts, rather then complain about the banks themselves.

 

Lets stay focused on the issue and keep applying more pressure toward the FSA.:D

Numbers is the key here - the more people we have complaining the more Westminister is going to take note, the FSA will change their direction like a wind sock in a storm.

DoS dont worry these things start off slowly but they are exponential in nature and suddenly grow at a phenominal rate.

 

People need to vent their anger and so will be looking for a place to do so - what better place to vent ones anger - than at the FSA.
