Advice required please.

 

Subject to actual receipt of funds from RBS - selllement in full (no interest though) letter received and accepted. Approx 7k but I will see none of this as it will go against bank overdraft.

i have a small claim in with abbey bank - approx 180, which if successful will clear abbey o/d.

next I was going to start on credit card charges. my problem is that with the DMP , most have stopped interwest, and all have now suspended charges. If I claim back charges from them are they lically to renage on my DMP, which may end up costing me more than a refund on charges

Any advice would be welcome

Mmmmm, not 100% sure on this one, but I would say that if you contact the people who are managing your debts and explain what you are planning to do they will be able to advise you. I wouldn't have thought that they can go back on the agreement they have made but I'm really not sure. If you read around there are other people who are on DMP's and are doing the same thing. If I come across any on my rounds I'll come back and post them for you

Try this for starters. Apparently it's a charity that offers free impartial advice for people with debt problems and don't worry, I've been there and done that, so I know what it's like dealing with debts. You will see the light at the end of the tunnel

i,m actually with payplan but they havent been able to give any assistance on what effect claiming illegal charges will have on my existing creditors, I dont want to recoup say £1000 back in charges only to have my creditors start to re impose interst and fees etc, which will cost me more than i save.

Yes I know what you mean. I really don't know how to advise you on this. Try phoning the helpline and see what they think. They may have some idea of how the companies may react if you were to claim. I'm sure they've probably dealt with this type of situation before, but keep reading because you may find others who are in the same situation. I know that I have read similar threads, but I'm just struggling to find them at the moment.

I'm in a DMP with CCCS and am claiming back charges from Abbey who also happen to be one of the debtors my DMP is paying off.

 

I'm at the stage of my claim where Abbey have filed a defence and made me a 65% goodwill offer. From the many communications I've had from them they've not once mentioned my debt which is still frozen till the DMP expires..

 

If they did decide to slap on interest then say the debt is in dispute and pay nothing until a resolution is attained ie; they pay their charges back in full then you pay your debt. :)

my problem will be that the charges are more than likely to be less than the debt I have with them, but I think it is worth a go

Worst case scenario is that you could have a slightly smaller debt :)
