Received yesterday from the courts "Notice of proposed allocation to the small claims track" This gives me the option of small claims mediation Is this something i should agree to?

I said earlier that i didnt know if received any new T and C Yes - own mortgaged property and3rd largest creditor in a DMP of approx 80k

I was told further up the thread that it was unenforcable as it is a store card converted by MS to a credit card I am in a dmp and making monthly payments to therm, but obviously they want to get in front of other creditors by issuing judgement, claiming goods, charging order - whatever they see fit I dont really have a defence - I dont want a ccj against my name and I was recommended here to obtain advice/ standard templates to help defend my case If I have misunderstood then I apologise

yes but need to submit a defence by weekend otherwise its judgement in default - t=is it a cca request i put in for?

Claim Issue daTE 1/10/2013 - ACKNOWLEDGED WITHIN 14 DAYS POC 1.Defendant entered into an agreement regulated by the Consumer Credit Act 1974 with HSBC BANK PLC 2.by deed of assignment HSBC sold all of its rights to the claimant 3. The defendant has been given notice of the said assignment 4. The defendant has breached the agreement by failing to make payments required under its terms 5.The defendant has been served with default notice 6 The defendant remains indebted to the claimant under the agreement in the sum of 8832.81 7. the claimant claims the said sum of 8832.81 plus interest for such period and at such rate as the court thinks and costs Cant remember seeing docs under 3 and 5 but not entirely sure Account started off life as a M & S store card which got upgraded to a credit card

Help please In a DMP but have received a CCJ claim form from Marlin Europe who bought a debt of HSBC (a marks and Spencer card) The DM company arent being much help at the moment and seem content to let a CCJ be entered against me value is 8k I have missed a couple of payments to the DM company What can I do - need to get my response off to the courts on Friday

Thanks 42man. Used your text as part of my defence, with slight amendments to reflect credit card debt, rather than bank debt. I have now received allocation questionaiire. Any help will be gratefully received -

i have now received a reply from Cohen solicitors "We are not obliged to provide this information, and wold advise that the particulars of claim detailed in the county court claim form should be sufficient for you to respond accordingly. please respond to the claim form with either an approprite defence or an admission and offer of repayment. failure to do so will result in judjement being entered without reference to you" How do I now respond??? -

Thanks for the info. I will submit my acknowledgement at weekend, then send letter to solicitors. looks like i need to spend a couple of nights reading thro this forum
