      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

This is my first message but i have been a long time reader. We have had a letter from the MCOL 2day which says LloydsTSB are defending our claim. I have just seen that LLoyds has won their first defence against charges. My husband has had his doubts right through that we will never win but i have told him not to worry. He doesn't know about LloydsTSB victory yet but when he does he will try and make me give up. Please help. What can I say to give him confidence even though as i am writing this i have a sick feeling to my stomach.:mad: Does anyone think we could still win? Each month that goes by makes us sink further into the mire and we are very worried.

dont panic!

it seams from the recent tsb win case that the claimant did not present the case correctly and the judge has stuck it out!

no doubt there will be an appeal and all will go well!

dont give up just for one case!

Don't worry. I've succesfully claimed £400 from Lloyds this year and they defended their claim as well. They sent a cheque before going to court - most banks will say they defend claims but never go to court. I found the stuff on Consumer Action Group site invaluable and I was scared as well when I started. Since my success with Lloyds, I've claimed back £1047 from Nat West for an account I closed three years ago. Again, Nat West acknowledged the claim and gained 28 days to file a defence but they never did. On the 26th day I got a nice fat cheque from their solicitors. The funny thing was that the day after, I got a letter ffrom Nat West customer services offering me a £900 settlement. Left hand and right hand I think - some things never change. Currently got a claim in for £2800 for my wife from Nat West but not heard anything from them yet. The Lloyds success doesn't mean anything. It's not binding on any other court and they may lose on appeal - I suspect the bloke involved will dot i's and cross t's for the appeal. Don't forget also that the OFT are investigating charges at the minute as well so the ball is stil in our court.

Thanks for that, bongobaz its good to get my first post out of the way and become a member of this forum. We will keep going now. What do we do now that LloydsTSB has responded to defend. Do we have to reply or wait for correspondence from court?? If you understand whast i mean.

Hiya,

I have just been reading your post, I to am claiming from Lloyds, I have filed a court claim as they did not respond but this week I received a final response letter from them and they deposited £750 into my account, I am sending a letter to them to accept this as part of the claim, they have not replied to the court as yet and it is 14th day tomorrow?????
