      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

What a glorious thread - and in technicolour. Have just sent off to Information Commissionair myself and filed N1 for non-compliance against Howard myself. So far I've only received data twice (on 2 accounts). Don't you feel sorry for your postman.......... Looking forward to your next posting.

 

Just to ask a question. Filed against natwest for non-compliance but have managed to obtain whole banking history from my local branch. Should I now drop non-compliance as compensation would be good but I think judge would look on my application as abuse of court time. It is worth saying that I filed against Ms Tudor (data controller) but because I put her business address the courts have returned N1 to me. Can always go down compensation route via FOS when I win, after all.

Wow - 14 years. I wont ask here how come you got statements going that far back. Just going to file for non-compliance next week as they only sent me statements going back to '96. I know where to come for advice when doing my poc. Your thread is about to get even more interesting. (When I have woked up I will sit down with large cuppa and reread this thread.) I had complained to the Information Commissionaire who wrote to Halifax ordering them to send me all data. They did sent me currenta/c data back to 1992 but only '96 with visa. I was assuming that I let the court know on Tuesday that they have failed to comply with commission's order for all data. Am I wrong?

 

Tilly I do hope noone has been leading you astray.......... Keep taking the tablets

I can only say how well your POCs are written - I CAN UNDERSTAND THEM PERFECTLY and I'm weak on this aspect. It also makes me feel like a leech as I intend to use them for several accounts going back years. Many thanks and can't wait for the next installment

Will they bother though? It would be lovely to think that banks being so short of money with the mortgage debacle (irritating to think that when they mismanage their account they go crying to the Bank of England but tell us to look after our finances better) they will see sense and settle 'cos the compound interest will hurt if it carries on till next year.All the best :)

I've got a week booked off work in September so I will have a good read of this stupendious thread. Am I correct in my thinking though that you have so far NOT filed against your current account? I was toying with the idea of just filing against the credit card for the time being but reading page 42 I am now considering checking PPI as I owe them more than I would be claiming. Given that I have had a win in the past can I do this?

You can't submit documents like the above and expect to be taken seriously by the judge. I'm terrible at understanding legal documents compared to some people but even I can see they have not put a single answeer to what was asked of them. A win is on the cards before christmas methinks.
