Story so far:

 

09/02/07 - DSAR letter sent

16/03/07 - Data received & cheque returned (very kind of them)

19/03/07 - Request for Payment sent

 

I'm claiming £250 plus interest for that account and have given them 10 days to respond before I send my LBA.

 

I received a note of charges on another account with them where they'd charged 2 x £12. Is it worth pursuing this £24? Has anyone else had any success in reclaiming £12 charges?

If you have used the template letters form here ~~> http://www.consumeractiongroup.co.uk/forum/bank-templates-library/671-2-letter-preliminary-approach.html you will see the timescale is 14 days, it is also 14 days for the L.B.A

 

I have found through experience it is better to stick to the tried and tested methods.

It is not cause for panic, but, i would advise sticking to the well trodden path ;-)

Both the 10 and 14 days have come and gone, and still no reply from MBNA. I called them today and was told that a letter was "generated" on 30th March but I still haven't received it.

 

Story so far:

 

09/02/07 - DSAR letter sent

16/03/07 - Data received & cheque returned (very kind of them)

19/03/07 - Request for Payment sent

12/04/07 - LBA sent

 

This time, they are getting 14 days and that's all. The operator that I spoke to said that she had been helping out in their billing enquiries department and that they were working their way through all of the claims. MBNA are paying out the difference between the £12 and whatever the charge was. I say "No thanks!" to that. I want my £250 back, not the £118 that this would generate.

I finally received a response from MBNA today. It was their usual "our charges are fair", "you knew when you signed the agreement", but "in the interests of goodwill" ... they offered £120 against the £250 + interest I'm claiming.

 

Well, they can get stuffed. I will be downloading the court forms and getting them to the Sheriff Court next week.

I've got their cheque now and I want to send it back - could somebody point me towards the template letter please? I've looked in the library but didn't see anything.

 

I've printed off the court forms and am unsure what to put down as the reason for the claim. Do I put "unlawful bank charges" or what? I can't see the pictures of the court forms that are posted on the site and I'm guessing that the information I need is there!

Cheers Stevo, but I can't see Scotia's forms. I phoned the court and the lady there said that in Section 4 you put "The Pursuer claims from the Defender the sum of £XXX plus interest plus costs".

 

I have sent MBNA's cheque back to them today.

Cheers Stevo. It's not that I can't find Scotia's thread, I can't see the embedded pictures because of the security settings on my work's computers. :(

 

The Fun Police are afraid we might find/do something on the internet that makes us vaguely happy.

oh i see, thats not very good, if you could see them, then all you would have to do is copy it and change it to your personal details.

I have used it four times, but i dont have hard copy of it, because when you fill out the court forms in .pdf, it doesnt allow you to save them, therefore ive had to type it out everytime.

No point asking if you have access to another PC, you would have tried that already. I guess you couldnt see it if i put it in an email and sent it to you either!? Ill have a think about it

Thanks Stevo. I have nipped round to my uni to use a PC here and I can see the pictures now. I've copied the text into a word document so I can use it again.

 

Do you think it would be worthwhile asking a mod to post my copyable text onto the bottom of Scotia's post to save people having to type it out every time?

It should be editable too - I've just highlighted, copied and pasted some text from your post into a Micro$oft Word document and it went in as editable text.

This is what I have put in all my cases and they have all worked out fine (touch wood) section 4 The pursuer claims from the defender the sumof £---- with interest at the raste of 8% annually from the date of service together with the expenses of bringing this action. On section 7 ( which causes a problem for some people) I put. The pursuer has had a ( bank account or credit card ) with the ---- for several years. During this time there have been a number of high charges because of late payments over limit etc. These charges levied against my account allegedly connevted with " costs involved" constitute " penalty charges" The amount bear no relation to the actual damages incurred. I have tried to get these charges refunded to no avail, therefore this action is necessary. This is a consumer contract therefore --- sheriff court has jurisdiction.

 

 

 

See seperate sheet ( this is where I have a copy of the spreadsheet showing all the costs etc. Hope this might be of help:) Any way best of luck If I can be of any help let me know

11/05/07 - Lodged claim in Glasgow Sheriff Court

 

The Clerk was really impressed with the forms (thanks Scotia) and even asked if I was a solicitor. :lol:

 

Now I just need to wait for the hearing date. Will keep you guys posted.

I received a letter from the Sheriff Court today giving my return date and preliminary hearing date. They're not until July, but I can wait!

I have to phone the court the day after the return date to find out if MBNA have lodged a defence .

I got a letter from MBNA yesterday offering me the charges plus interest! I called them and said if they'd give me the court costs too, I would cancel my court action - but not until I receive their cheque and have cashed it.

 

The guy said they'd issued the cheque for charges + interest, in addition to the first cheque they sent me. When I said I'd sent the first one back (which I did) he said he'd get a new one out to me. They're sending me charges + interest + court fees + £120!!!

 

Result!
