    • So, Sunak has managed to get someone to 'volunteer to go to Rwanda hasn't he? .. for just £3000 payment to the person plus 5 years free board and lodging isnt it? - cost to UK taxpayer over £300M+ (300 million quid+) isnt it? - Bargain says Rwanda, especially with all the profit we made privately selling those luxury chalets Bravermann advertised for us   I wonder how many brits would jump at that offer? Thousands? Hundreds of thousands? Lets see, up to 5 years free board and lodging and £3k in my pocket .. I'd go - and like that person - just come back if/when I get bored. First job - off to Botswana for a week to see the elephants.   Of course the paid volunteers going to Botswana are meaningless - Rwanda have REPEATEDLY said they wont take any forcibly trafficked people in breach of international law eh? Have they actually got any civil servants to agree to go yet - probably end up as more massive payments to VIPal contractors to go and sit there doing nowt shortly eh?    
    • Hi Wondered if I could get a little advise please. I entered into a commercial lease (3 years) and within a few months I had to leave as the business I was trading with collapsed. I returned the keys to the landlord and explained the situation and no money, also likely to go on benefits but the landlord stuck to their guns. They have now instructed solicitors to send letter before action claiming just over £4000. The lease was mine and so the debt. I know this. I have emailed the solicitors twice to explain I am out of work and that with help from family I could offer a full and final settlement figure of £1500 or £10pw. This was countered by them with an offer to reduce the debt by £400, or pay off the amount over 12 months. I went back with an improved full and final offer of £2500 or £20pw. This has been rejected with the comment 'papers ready to go to court'. I have no hope of paying the £4000 and so it will have to go to court. Pity as I have no debts otherwise but not working is a killer. I wondered if they take me to court, could I ask for mediation? I also think that taking me to court will result in a pretty much nothing per week payment from my benefits. Are companies just pushing ahead with action even if a better offer is on the table?       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

received second cheque from the Yorkshire on Saturday, its £120 less than i was claiming, so i need to decide tonight to accept and cash the two cheques i have for both my claims or send the latter one back asking for the £120 which was for my AQ FEE,

 

got back £2700 which has been my longest claim todate.

Need to phone them to have it concluded before court, do you still bank with them, if so ask them to credit the account, or give them your other bank account details and ask them to bacs it through, although your cutting it fine for monday as you still have the cheque and id assume they wont do any of that without that cheque back.

Did you get a copy of the court bundle for YB? Also witness statements? I'm guessing not. If you haven't got the payment by Monday phone the court for advice. As I see it you don't have cleared funds in the bank so you haven't been paid. I'm not sure how the judge would see it, but I think you may still be able to pursue the court case if you wanted to. If they haven't submitted the bundle, don't turn up, and haven't paid, I think the defence could be struck out and you would win by default. You have them by the throat in my opinion. Check with the court in case I'm getting carried away here.

 

Alternatively you could accept that they will pay and let the court know you've settled.

my claim has been paided out, my problem now is that they have put mine and ex gf names on the cheque, but i cant cash it as its in joint names, my ex lives hundreds of miles away!

Alymac, i would ring the bank first thing monday as they open before the court and inform them they have sent you a cheque you can't cash so haven't paid, it's the same as sending an unsigned cheque, tell them that the hearing is today and you are going to ring the court to inform them. Then ring the court and they will advise you. I would be quite prepared to go down to the court if need be.

I agree with Moss. Please answer my questions about the banks bundle etc as this could be crucial. Be prepared to go to court if you don't get a satisfactory answer from the bank on Monday.

I was on and off the phone to the Yorkshire on Friday. spoke to a really nice and helpful girl called Louise in there customers relations department. she tried to get the legal dept to see sense and issue one cheque in my name, they were having none of it, i then asked if i get ex to sign disclaimer, they dismist this as well. all they could to do was issue two cheques.

 

fair enough but it was my account that i put ex on to she never used it, never paid a penny in or took a penny out.

 

claim was solely in my name.

So what are they saying, if you've split with your partner and no longer have a joint account you cant have your money back or you can only have half, who are they to decide personal issues,surely it's the claimants reasonability to pay anything due to their ex.

thats it i can have half, they will keep the other half, incase my ex makes a claim,

 

so half is around £1000. remember i have paid £220 court fees, plus around £50 in postage,stationery etc.

 

i will go to court on monday, explain this to the judge and see what he says.

 

its took me 8 months to file this claim, a lot of research just to give half it away.

I have just left a voice message Alymac. I agree that you should go to court, but in my opinion your best bet witll be to see if the judge will strike out the defence as the bank have not submitted a bundle, and I think are unlikely to go to court. As the bank have paid a cheque it might be seen as settlement, but if your ex claims in future, maybe the bank might refer her to you for payment. Your claim is in your name only so as I see it they have imposed a condition to the settlement that is not unacceptable to you. I'm not sure how that would work. Look again at the CPR on joint claims just in case you need to be clear on it in court.

Alymac, i would of thought that if the bank settled out of court for a sum equal to the total of your bank charges your ex would then have to claim of you as there is no longer a claim against the bank as all charges on the account have been refunded. I think this is just another obstacle they are putting in your way and a silly one at that as the hearing is today

ADJOURNED

hi, not to good, was met by Representative of the Clydesdale, he just stated the banks position, judge was up to speed before we went in which was good, he states the my ex must be included on the claim which he then did, but he did state that if we can sort some thing out without the need for further court action.

 

i will try and get ex to sign her share to me, which the bank were not to happy to do last week.

 

judge was happy to go with that, as i stated that half was not good enought.

Not as good as you might have hoped then. Do you know who it was representing Clydesdale, and what did they have to say? How did they get away with not submitting the bundle?
