    • There is no evidence that I was issued a PCN that was placed on the car and removed. It seems that I was issued a £60 PCN on the 8th of March (the parking date) but it was never placed on my car, instead,  they allege that they posted the PCN on the 13th of March and deemed delivered on the 15th. I never got this 1st £60 PCN demand. I only know about all of this through the SAR. I only received the second PCN demanding £100, which was deemed delivered on 16/04/2024 - that is 39 days after the parking incident.  I did a little research and "Legislation states that postal PCNs must be sent within 28 days, unless otherwise stated in the Regulations." as per London Councils Code of Practice on Civil Parking Enforcement.  The main issue is that I was not aware of the 1st £60 PCN as I didn't receive it - I'm not sure how this relates to the 28-day rule because that rule applies to the initial £60 PCN. PCM could say that "we sent him the letter by post and it was deemed delivered on the 15th of March" therefore the 28-day rule does not apply.  As regards the safety of the parking attendant, that is clearly something he chose to feel and he made the decision that his safety was threatened - I didn't even see him or had any interaction with him. I'm nearly 50 and I definitely don't look aggressive 😊

    • Personally I would strongly suggest not risking going there with debts. Very possible you wont get back out again. And I know many in that position. Not jailed just unable to leave. the stories of Interpol in other countries sounds far fetched but in and out of Dubai is not a good idea. only two weeks ago a mate got stopped albeit a govt debt.
    • BTW the time in and out is less than 10 mins, more than 5 in case that's relevant? I saw an article posted on here about a year ago a proposed legislation change but i don't know if that went through or not? I'm also a blue badge holder but there it was a regular parking spot.   Private parking fines to be capped at £50 WWW.BBC.CO.UK Drivers will also need to be given a grace period for lateness, as part of a crackdown on parking firms.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Thank you for your email. With respect, we do not believe that a £26.60 reduction in the quantum of your claim represents a genuine desire to resolve this matter without recourse to the Courts. Whilst it is not our desire to litigate with our customers, some charge must be applied for the transitions that have occurred on your account.

Should you wish to reconsider your position and put forward a more commercially palatable offer representative of the transactions that did in fact occur on your account, we will be more than happy to consider the same.

I however actually think £26.60 is a rather genorous offer of the costs incurred due to my contractual breaches as they are made up entirely from going over my limit and not unpaid DD's due to insufficient funds. £0.29 a time (max)I think as it's all handled by computer and the bulk of the cost is the letter and postage and that's being generous LOL

So now to draft another reply to Inga.................;)

Ok have just kicked off my reply to Inga as a final attempt at resolution:

 

Dear Ms Kirkman

Thank you very much for replying to my email, it was most appreciated.

I was interested to note the contents of your reply and I am willing to drop my offer of settlement to £6850 as full and final settlement of this claim. I am aware of my duty to mitigate my losses and conclude that this should be a more “commercially palatable" offer to Abbey.

As a condition of your acceptance, I will require a cheque for the full amount is with me no later than the 24th June 2007 after this time I will conclude that this offer is unacceptable and will continue my claim with the court, which will include interest to date of settlement, court costs and a wasted costs order.

I would be happy to pay the actual cost per breach, if Abbey would reveal them, and such time that you do, I will be requiring repayment as set out above.

I actually hope it gets into the Court as I can get all my costs too....... £6.75 a letter..... prep and research time....... travel...... time off work....... and the best bit is...... I actually included it as part of my claim so they can't settle just my charges and interest claim..... mwaaahahahahahahahahahaha........ the World domination bit tomorrow methinks? ;)

Well as of todays' post, no offer accepatance OR cheque from Inga. Last day tomorrow's post.

 

Considering my offer and the interest and costs to date, I am saving them nearly £800!!!

Rightyho then......

 

Just had it confirmed by the Leeds Courts that my case is to be listed in the Mercantile Court in Leeds.

 

Now just awaiting a date as all the communications, offers and points of fact and Law is all on my side. I also included a clause in my claim that the claim isn't settled unless all costs are refunded as well due to the shAbbey's unreasonable behaviour and it's not less than £360! (Interest is still accrueing on the claim at £5.86 per day.

 

Take your time shAbbey, I've all the time in the world! PS....... can I save with you?....... ooooo silly me I'm getting triple your advertised rate already......:rolleyes::D

To answer your query it's the value of your claim plus interest to date. Do not put in the costs such as filing your N1 or AQ but if part of your claim consists of the SAR process then I would include the £10 fee in there to.

 

If you need to, just attach a spreadsheet listing the charges and interest rate / amount in Section G/H if required to let the Judge be fully au fait with the amounts involved. The JUdge will appreciate this as you are ensuring he has full access to the facts and figures to hand.

I have received notification from the Harrogate County Courts last month that this claim was being transferred to the Leeds County Courts. Today I have received a letter from the latter informing me that this case has now been transferred to the Mercantile Courts in Leeds. No date as of today has yet been set.

As such and to save you added expense of a Wasted Costs Order due to your unreasonable behaviour and further interest, I will settle my claim if a cheque for the full amount (As of 27/06/07 stands at £7091.12 plus £5.41 per day interest) is sent to me no later than Friday 13th July 2007.

This will be my final offer.

 

I do so hope that Abbey National will now appreciate what they would have saved if they had only accepted my earlier offers.

And to compound it all, I received a letter this morning from shAbbey rejecting one of my earlier offers!

 

Dear Sir

28th June 2007

Without Prejudice

Thank you for your offer of settlement in the sum of £6968 plus £10.60 from the date of your offer until resolution.

Your offer makes no account for the transactions that have in fact occured on your account. There must be some charge for those transactions.

Should you wish to reconsider your position and put forward a more commercially palatable offer to Abbey National PLC, we will be more than happy to consider the same.

Firstly my thoughts.

 

"Without Prejudice" - this is in reply to my first offer that was made and was not marked "Without Prejudice" as I wanted to include it in my bundle. Therefore their letter does not afford the priviledge!

 

Secondly, their claim that my offer makes no account of the their right to charge me something for my admitted breaches. Of course and it has never been denied. But until they give me figures and / or disclose their true costs how can we attach a figure? After all it is their responsibility to do so and we are not forensic accountants!! So what I offered them (even though I in real terms only lowered my claim by £30-£40 gave a generous offer as to @ £1.20 per item as restitution.

 

That offer has since expired but during that offer phase I replaced it with a more "commercially palatable" one which dropped @£300 off my claim. That has also since expired and my final offer which is for the FULL amount now expires on Friday 13th July 2007. This figure for settlement minus all my costs (which will be applied/negotiated for as it is also part of my claim stands at £7107.35

 

So if they had only accepted my second offer before I put in my final offer upon it's 2 week expiry date, would have saved shAbbey @ £800-£900

 

COMMERCIALLY PALATABLE? :rolleyes: F$£%wits!
