    • Well, that's it then. Clear proof of the rubbish cameras. Clear proof of double dipping. G24 won't be getting a penny. Belt & braces, I would write to the address LFI has found, include the evidence of double dipping, and ask Fraser Group to call their dogs off.
    • LOL. after sending Perch capital a CCA request with a stapled £1 PO attached (x2) Their lapdog Legal team TM Legal have sent me two letters today saying "due to a recent payment on the account, your account is open to legal/enforcement action" so i guess they have tried to apply that payment to the account to run the statue bar along. dirty tactics lol.
    • I have initiated the breathing space so ill wait. from re reading everything this what i understand BS gives me 60 days break from the creditors during these 60 days they may contact me and will most likely default I need to wait until after a default notice to see whether the OC will keep the debt or sell it off If kept by the OC then i should attempt a plan or pay some token payment? If sold to DCA then don't pay and after 6 years it will leave my credit report once the DN is registered with a date. DCA may start a CCJ but unlikely, if they do come back here. last question, do you know roughly how long this will all take? in terms of defaults/default notice, potential CCJ? Would you say I have 12 months plus from when the BS ends?
    • Well, it's up to you. Years & years & years ago the forum used to suggest appealing to POPLA, but then AFAIK POPLA's remit was changed and it became much more biased in favour of the PPCs. One of the problems with taking that route is that the onus will fall on you to prove your appeal, while if you do nothing the onus is on MET to start legal action which experience teaches they are very, very reluctant to do. If you go down the POPLA route I would think your ace would be insufficient signage.  Are you able to go back there and get photos of their rubbish, entrapping signs?
    • The first clearly visible sign as you pull in to the car park states “McDonald’s Customers Only 60 minutes” The next clearly visible sign is an almost identical sign outside Starbucks which states “60 minutes free stay for customers only” There are other signs towards the rear of the car park (away from the outlets) that have the terms and conditions on them in very small print.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

No prbs Thailand.

I cant recall the exact date I called Woolwich asking them for a statement of charges against my account for the the 6 years but I think it was around end of Jan beginning of Feb. They Sent me a full list and a letter offering an initial £ 450 (received on the 16th Feb), I replied by letter on the 21st saying I do not accpet and that I would accept and inculded the interest calculations Claiming for a total of £ 1473.00 but advising them that I would settle for £ 813.00, they ignored my proposal and then I got a letter on the 23rd Feb offering £550.00 for full and final settlement, stating that 'should I choose not to take this offer and start legal proceedings then it is clear we are unable to reach an amicable decision'. sent a refusal letter today as posted on delboys thread and now just to sit back and wait. I dont think they will increase their offer at this stage but am prepared now to see it through. :-)

Ok Kerry. What letter did you send (before today) was it a template? From this site or another?

Did you just send a 'no' to thier first offer?

No offence Kerry, you really need to read all of the FAQ's on this site as it appears you have jumped in the deep end.

Whatever the case we'll sort it.

Hi Thailand,

I think you're right!! It was a template. Here is the letter.

RE: Your Reference XXXXXXX

Dear Ms xxx

Re. Account number: XXXXXX

Thank you for you letter dated 16/02/07 offering a settlement of £ 450.00 of which is not even equal to half of the amount and for which I am not happy to accept. I am writing to request that you repay all the default charges that have been applied to my account. I do not believe these charges reflect the true cost to Woolwich plc of going into unauthorised overdraft.

The charges total £1084.00 plus as I believe I have been unlawfully deprived of the money I have calculated £388.01interest at the statutory rate, the amount the court will award.

I therefore ask that you repay me the full amount of £ 1,472.01. I have attached a full schedule of the charges and interest with this document.

I am fully aware of the volume of requests you may be receiving due to the recent publicity on such matters and do not wish to be awkward or prolong what could be a simple negotiation process therefore I propose that you offer me a refund of 75% for full and final settlement within a reasonable timescale of the charges excluding any interest which would amount to £813.00 which is equal to £ 659.01 less than the full amount with interest that I have claimed above.

I look forward for a full response to this letter within 14 days.

Yours faithfully,

.

That was the letter I sent back after their first offer, have I really messed it up now...?

Apprecitae your guidence.

Kels :-)

Firstly about the ERC PM. It is not recommended at this time to pursue this especially as you have too much on your plate with this claim, and you've alot of homework to do too...

I will link you to the Zoots ERC thread shortly.

Regarding this claim, I think of one thing you could do and then another one pops up to the contrary.

I'm thinking start a fresh, or send in Letter before action citing they did not take you up on your offer therefore you have retracted it and are pursueing the claim in full, I don't know and hope someone comes up trumps for you.

You haven't set any real deadlines and have been inconsistent with your requests. I am not being rude for a second, just trying to get my head around the possibilities.

I hope someone knows more, In the meantime click FAQ in the above blue bar and get reading trooper!

Thanks Thailand. Appreciate your honesty. I have already posted the 2nd refusal letter today (the one posted on delboys thread). Do you think I should see what they come back with by 07/03/07 or just start a fresh from today?

Can't see any harm in that, its gone now anyway. Lets see what goes on.

Do you want me to copy and paste that letter here so peeps know where you are up to?

You have set deadlines by the way, I'm a little confused if they are Ok.

Thanks thailand that would be great new to all this as you can prob tell! hehe. With regards to the ERC its pretty non standard, I wanted to stay with the lender but there was a little unreasonable behaviour or at least thats how we interpreted it on their behalf. I'll post a thread and get some opinions or though have no intentions of biting off more than I can chew :-)

Response to settlement offer – Your Ref: XXXXXXX

Dear xxx

Thank you for your letter dated 23/02/07.

I respectfully decline your offer as Full and Final settlement and request, once again, that you return to me all charges imposed on this account, totalling £ 1,472.01.

I will accept the sum offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder, with a County Court claim if necessary.

My Request for Repayment letter dated 21/02/07 indicates that you have until 07/03/07 to respond before I proceed to the next stage . My deadline remains the same despite this offer.

If you do not accept my conditions for acceptance, or you do not respond within 7 days, I shall proceed with my claim via the county courts. For the avoidance of doubt, I wish to stress that I do not accept your offer under the terms stated in your letter.

I trust this clarifies my position.

Yours faithfully

Re ERC, thats cool Kerryanne ~ I don't know anything about ERC's other than there was some concern. I'll PM you the other link hun.;)

My view (for what its worth! - I'm no lawyer!)

Woolwich have stated that if you refuse the offer then it is clear you can not reach an amicable decision. They are aware you are willing to take them to court and acknowledge as much, therefore my view would be to go for the MCOL on 07/03/07. Thats the final deadline you have given them.

24 hours in a day... 24 in a case... co-incidence???

I hope MCOL is cool too steve. I 've just noticed that the first letter Kerryanne sent was the 21st of Feb just 6 days ago, and another today.

I don't want to further confuse anything but I'm now thinking, if we have to give them 28 days maybe it would be better to think of a date around 21st - 23rd March?

Any thoughts?
