      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Just a quick update.

I received two letters yesterday, one from Abbey in response to my LBA on the 1st June. Basically its telling me to do a running jump, as there is no way they will be refunding my money, and if it goes to court then they will review each case independantley.

The second one was from DLA Piper etc etc, wanting me to send a breakdown of charges. Just printed off my spreadsheets which are getting posted tomorrow. Just for anyone interested, the name under the DLA Piper signature is Laura Gordon.

I will of course keep you posted on any developments.

I have just checked the MCOL site, and Abbey have acknowledged my claim. Is this quick? I have been reading posts in which Abbey are not acknowledging, and so the OPs are going for defaults. Are Abbey changing tactics? Would be interesting to know.

I am exactly at the same stage as you. Abbey have acknowledged my claim today and they have 28 days in which to file a response. Shocked me a little bit, but oh well nothing ventured, nothing gained.

Time is running out for Abbey...they have acknowledged, and have up till midnight on the 31st. Are they going to defend at the last minute?? Is this usual? Or are they getting bogged down with all these claims going on?? Getting itchy feet now though....

I have received this morning, Abbeys defence.....along with the 50% offer.:rolleyes: .(sorry, as if I expected anything different!):-) can now see a light at the end of the tunnel!!:D .

Hi everyone,

 

As you know last week I got a 50% offer from DLA, and was looking to refuse it point blank, and hold out for 100%. :)

However, I thought I would try for an early settlement, so put a counter offer of 90% to them, not expecting them for a moment to accept. But I have just received an email from DLA, saying that Abbey have agreed. :o

So I have lost approximatley 250.00, and hopefully will have my cheque in the next week or so. I am extemely grateful for all the help and advice that I have received from all the people on here, especially the Admin, Mods and site helpers, as well as the words of encouragement I had in the beggining when I was just starting out. So THANKS EVERYONE!!!!!, I am now £3080.45 better off, money that I thought I would never see again, and money that was taken from my children.

Needless to say, a donation will be on its way, once I have my cheque and it clears.

I will still be around, to pursue my Capital One claim, so I will continue to keep an eye on the abbey forum, and continue to watch the 'I Won!!!' posts.

Egg - Recovered £220 due to Customer Services misinformation - Feb 2007

Nat West - Prelinimary Letter to recover on Credit Card charges £30.00 sent March 2006. £25.40 offered - rejected and the bank reckons that this is it's last word on the matter. We'll see if that's still the case when it reads my N1 form sent recently. It has until the 17th April to respond or the N1 will be submitted.

When I write to court to say that the claim has been settled, (obviously when the cheque clears!!;) ), do I need to write anything in particular, you know, like 'wasted court time again' or just write a bog standard letter?

Its great to read the success stories when you're still on the bottom run of the ladder.. I took my data protection request and £10 cash into Abbey last Fri so I'm only just starting with my attempt to claw back some of my much needed cash from the fat cats.. It's so uplifting to read stories like yours and it reassures us newbies that there's something worth fighting for! I'm completely over the moon for you... keep us posted how long you end up waiting for the cheque?:confused:

When I first started my claim, I was very apprehensive...I didn't think that I would get a penny from Abbey. But thanks to all the wonderful people on here, and the positive threads/posts, I began to realise that yes, I would fight for MY money.

Only thing I'm worried about is if they close my account, did they close yours? i thought Id successfully opened a parachute account but received letter today to say sorry but they were unable to offer me a current account at present so praying Abbey don't go down that path with me... Suz

It will soon pass, I can't believe how it seems to fly, once you have filed your claim. It really is just a case of biding your time, and waiting, although like it has been said so many times, 'WHY DON'T THEY GIVE IT BACK STRAIGHTAWAY!!!:mad: '

 

Regarding my account, it has been closed since January this year, so I expect they were a bit peeved that I've reclaimed my money, and can't retaliate!

Try Co-op, I got one with them a month ago, even having started this claim, but to be honest I don't think from reading the threads that theres anything to choose between any of them!

 

Anyway, keep posting updates. I will continue to watch the Abbey forum, feels like I have a duty too!!

Hello there, I am new to all this, was recommended to this by a neighbour.

My wife and I have held a joint Abbey account for the past three years or so and have had some charges against us in the past and we both have individual Co-op and Barclays accounts (bank current accounts) that we are interested in making claims against. How about credit card accounts? The only thing is that I have had credit cards in the past that I would rather forget about or have forgotten about. Any thoughts or advice. I am in the process of reading the FAQ.

You are doing the right thing by reading the FAQ's thoroughly, although this sounds daunting, the more threads about Abbey you read, the more confident you will become in making your claim. ( See my first post!)

Follow the step by step, sending out the template letters in order. Our bank account was a joint one, and I have had no problems making the claim in my name, so you should be safe to persue your claim in just one name, providing you don't have an account where both signatures are required.

Yes you can claim charges on credit cards as well, just follow the same procedure, making any amendments as necessary.

I have just started my claim against Capital One.

 

You will need to start your own thread, for each account that you intend to reclaim. For example if its Abbey, go to the top of the Abbey forum and click 'start new thread'. Think of a title and bob's your uncle! (apologies if you already know how to do this, sorry:-) )

 

When you have done this you can update on your progress, and ask any questions if you run into difficulty, and everyone can see what stage you are at.

 

Although you may feel a bit apprehensive at the moment, you will soon get the hang of it, and remember, there are no strangers on here, just friends we havn't met yet. Good luck.

As you know I offered to settle for 100% of the charges, the court fee but dropping the interest element. I gave them til today to respond. They haven't, so I will be filling in my allocation questionaire tonight and sending tomorrow. I am a bit unsure as to whether I am glad now that they haven't responded. I had to agree to pay the difference between my outstanding charges claim and the balance by the 1st September to avoid my account being defaulted. The interest comes to nearly £700 so that would be a help.
