    • Thanks, I've had my fill of this lot. What makes me so mad is that I had to take out student loan to get any DHSS help.
    • there is NO exposure if you simple remove your name address/ref numbers etc from docs, over 10'000 pdf uploads are here. which then harvests IP addresses off of the people that then do so..which is why we do not allow hosting sites. read our rules and upload carefully thats exactly why we say capture as JPG, redact, then convert/merge to one mass PDF. then online sites to achieve that we list do not leave watermarks.  every once in a while we have a user like you that thinks they know better...we've been doing it since 2006 with not one security issue. thank you.

    • no they never allow the age related get out, erudio are masters at faking supposed 'arrears' fees which were levied before said date and thus null its write off. 1000's of threads here on them!! scammers untied that lot. i can almost guarantee they'll state it's not SB'd too re above, but just ignore them once sent. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Re: my previous suggestion about the stat notice. I think these stupid people at least take notice when they see one of these things in their post. By the time it's dawned on them that Chez has signed it, they may well have called off the dogs !! Job done. Of course, Willow's right that it technically has to be SIL who signs if you're issuing it for real. But the idea here was for it to act as a "laxative." :o

Do you think this is ok for the 1st paragraph of the SCA request ...

 

With reference to the above account, please supply me with a true copy of the credit agreement under which this account is conducted for myself and my customer Mrs xxxxxxxx.

I'm basically using the same letter I sent to Littlewoods .... what d'ya think - do you think this'll cover 'all bases' so to speak?

Yeah, that oughtta do it, Chez. Make sure you specify the correct account number, too.

 

They all come under my main account but with mini account numbers ie... 710, 711 etc .... will make sure I quote them all to be sure!

Believe it or not this is still ongoing & I haven't had a reply to either of my letters to Freemans stating my disgust at how they are treating my customer

 

Also not received a copy of a recently printed credit agreement for my account following the CCA request signed by freemans (a preprinted signature!) so they are now in default with this - they said due to DPA that Mrs xx had to write in herself & they would respond to her directly although they do not send her statments etc as they come to me as part of my acc?!

 

Also, they've been applying charges to my account which I'm now gonna claim back & go through my old statements to see if there are any more .. got a bee in me bonnet now I have! (yes I forgot to send a payment - my fault I know but even so!)

 

I need to dig out all my old statements so I've been working on this 'nasty' letter tonight to try n shut 'em up a bit 'cos they keep phoning to talk to me even though I told them the account is disputed & I would write to them & was unwilling to speak on the phone as they can never find the taped conversations when you want them (refer to my request for the taped convo of the insurance being ordered! ;) )

Dear Ms Ferguson

ACCOUNT NUMBER: xxxxxx

With regard to the above account and the recent actions by Freemans PLC I am writing to state that I am absolutely appalled by the way you have been dealing with the account and sub accounts of late. I have now written to you on two occasions and had several phone conversations regarding account xx - Mrs xxxx. I have not received a reply to either letter and I can not believe that an organisation such as yourselves and with your resources cannot find the time to do this. I must say that the level of customer service, in my opinion is severely lacking here.

As previously advised, I note that you have now defaulted Mrs xxxx and added charges to the account. I request that you credit this account in full leaving a zero balance and take appropriate action to remove all default information from her credit file. A pure amendment will not be acceptable. I would draw your attention to Section 14 (1) of the Data Protection Act 1998, where it states....'If a court is satisfied on the application of a data subject that personal data of which the applicant is the subject are inaccurate, the court may order the data controller to rectify, block, erase or destroy those data and any other personal data in respect of which he is the data controller and which contain an expression of opinion which appears to the court to be based on the inaccurate data.'

Mrs xxxx is well aware of her rights regarding this situation and failure to comply will result in this being taken further and to court if necessary.

I also refer to account xxxx to which the balance has recently increased due to the amount of charges you have been applying. I am advising you that as a result of these applied charges, which I now believe to be unlawful, I am considering this account to be in dispute and am currently preparing a schedule of all such charges which will accompany a request for them to be refunded. Therefore no payments shall be made to you on these accounts until this is resolved and I trust you will deal with this accordingly by placing them in dispute.

Furthermore, I made a request for you to supply me with a true certified copy of the credit agreement under which this account is conducted. You have enclosed a copy of a recently printed agreement which is not what I requested and does not comply with your legal requirements.

 

Once again I remind you of your duty to supply all documentation under sections 77 and 78 of the Consumer Credit Act 1974. If you are not sure of your responsibilities and the exact documentation you are required to supply under this act, then I suggest you research thoroughly in order to carry out your legal obligations.

 

I remind you that you are currently in default under s78 [6] of the Consumer Credit Act 1974 and that non-compliance with my request is a criminal offence carrying a fine of up to £2500. Furthermore you are reminded that under the same sub section, whilst the default continues you are not entitled to enforce the agreement in law.

Whilst I understand that you may not find this letter entirely to your satisfaction, I nevertheless believe that you will find it perfectly in order, and I respectfully insist on a prompt reply, in writing, advising that all of the above is being properly actioned, or your very clear and lawful reasons if not.
