    • Okay, I have read your claim form. A pity you didn't come to us earlier. You haven't pleaded any legal basis for your claim and you haven't cited the Contracts (Rights of Third Parties Act. How long have you been aware of this forum? We will have to bring that out later when you do your witness statement. Once again, do the reading very carefully. I suggest that you wait until Monday before coming back here and confirming that you have read everything. And in particular, as I have indicated, read the thread which I posted above very carefully and in particular we the details of the contractual terms which were discovered and get a copy for yourself. Post a link to them in this thread as well for other people to see. They are relying on the fact that you don't have a direct contract with them and they are referring to a contractual term which is apparently in the contract between them and Packlink which specifically excludes third parties. You will definitely want to see this. They have tried to rely on this before but they have never produced the contract. In your witness statement you will have to request that they produced the contract in court. In terms of the mediation, frankly we would have advised you to decline mediation. It's all done secretively. Nothing is ever revealed and of course they will try to get you to compromise on the amount of money you are claiming. We would strenuously suggest that you don't give up a single penny. Do the reading that I have suggested, find the details of the contract which I have told you about which accepts direct liability to you, the customer – and post it here.
    • If there is no reply to the "nasty" mail in 48 hours, then please come back here and we can assess what to do.
    • In particular, read this thread carefully. it is a very long thread but be patient with it. Eventually you will come to the witness statement and also had a point where it was discovered that Packlink's terms and conditions make it clear that Evri have a direct responsibility to the claimant and the judge awarded full judgement to the claimant on that basis. We have applied for the transcript but it will probably take six weeks or so. If you're mediation fails and you go to trial then I'm sure that the transcript will be available for you. It puts an end to the claim by Evri that you should claim against Packlink and it puts an end to any need to rely on the Contracts (Rights of Third Parties) Act 1999

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hello people

 

just recieved letter from halifax offering full refund for one account but not going to pay out the total i am claiming for i see they only paying me back for one account any advice please 1 have 7 days to reply bit worried.

Most of my letters say the accounts i am claiming for at the top. and they only offering to refund one of the accounts. i must show evidence of why i am claiming £1400 odd ? should i telephone them ?

Were all of your accounts covered in one claim? You might need to phone to get the full situation - I had two seperate concurrent claims with them and each one was dealt with in a different way. If they are all in the same claim then one person will deal with all accounts (as I understand it).

Do you not know what the shortfall is ?

 

You can ask them to give you an explanation preferably in writing.

You are also entitled to accept what they are offering but not as full and final settlement,and that the action will carry on as scheduled.

 

I am not sure if you are obliged to let the court know beforehand of this.

 

I do know that this situation has arose before recently tho as I remember reading it.

how will i know they are both in the same claim ? at doesn't say that in the particulars of claim and mostly all the letters recieved from halifax has both roll numbers at the top ? any ideas
When you filed your Moneyclaim did you just state one account or many. Did you raise more than one Moneyclaim?

How much are you claiming against Halifax, how many accounts is that from, and how much are they offering for each one?

they are offering full refund for one account £918.00 plus interest of £95.35 and court fees £120.00 totaling £1133.35 but my claim is for £1493.00 this amount is for both accounts. this is for 2 accounts. thet refuse to offer me the extra 300 odd unless i can provide evidence

In that case it is worth phoning them to ask why there is nothing being settled against the second account. Use the number on their settlement letter - I found them quite friendly when I called in a similar situation.

 

EDIT: Did you provide a list of charges on that 2nd account?

i didn't tell them to send it within 7 days they just said it will be with you within 7 days but i did say it must be before 11th of july as thats when they should of filled a defence. thanks for the advice woman on the fone was really nice they red on the claim form it was for 1 account but i told them its for 2 so shes contacted the department for me and now they are going to send out another letter which i a assuming will be the for refund for both accounts totalling £1578.35 it will work out they way halifax have done it but my claim is for £1493.00 o well will keep it quite do doubt they will refund the claim amount but either way i will be happy and so will BAG when i donate

What I was meaning to say was that you obviously have to now inform the court of their settlement.

The Halifax are known to have pulled some fast ones lately so if you can get the refund before they have a chance to try and pull another .......

G to late i have sent the information to court now anyway. but there is nothing in the information given to court saying that i wish to stop the claim just just said that i am now waiting response.

just checked my account online and i am £37 over my £100 overdraft and haven't been charged funny that. is there a rule where they cannot charge me if my account is in dispute ? hoping to recieve reply this week for full refund for both accounts yipppppppe anyone know how long it take for them to refund the money into your account ?

Maybe the letter hasnt got to you yet as Gary Kettle is off sick ha ha.

 

They have been known to refund a charge during a claim but advise that the next one will be chargeable.

 

No firm date for refunds following the claim but they do appear to have a very predictable pattern /chain of procedure.

Mine was paid directly into the account 8 days after filing - but they do vary. It was a day or two after acknowledgement of the claim. Didn't get the letter for another day or so.

The pattern seems to be

 

DPA make you wait 2 weeks for statements

 

PRELIM They deny charges are unreal

 

LBA Offer around 25% of claim

 

Court papers served settle betwrrn first 7-14 days

 

 

Of course there are exeptions.........as we well know where there is an issue of default removal.

Clearly this is the issue they are waging war on to find a way around complying with.

As we hear many times they see this as their sacred cow and are battling to protect as their Oyster.
