    • The last photo shows the overflow carpark looking at the block which our room was located. When we got out of the car my partner thought that the building was for staff accommodation.  The unsecured bedroom window opened onto this car park.
    • Also I see that you are doing a lot of this on the telephone – and without any written confirmation. This is a big mistake. You need to start taking this matter seriously and so everything should go in writing. If you have telephone calls then they should normally be recorded. Read our customer services guide. You should make notes about every telephone call and then you should send an email to your telephone correspondence confirming what they have said or what they have agreed. It is important that you keep detailed paper trails here. Of course we may be jumping the gun and maybe big motoring world will step up to the mark – but I'm afraid that they have a lousy reputation has you have seen and so you need to start practising survival techniques and protecting yourself. You say for instance in your letter of rejection that the mechanic told you on the telephone that the gearbox needed replacing. Do you have any other evidence of this conversation? This is going to sound a bit harsh – but other people will be visiting this thread as well for their own purposes. You conducted their research about this company before you bought the vehicle. You now are fully aware that this is a company which can be very difficult to deal with and causes a lot of problems for many of their customers and yet you are still taking a telephone/verbal approach. Do I need to say any more? Also one of the documents you put up is an email exchange but it is not clear who is writing to who or what dates. If you showed this email to somebody in a pub they would be asking lots of questions about who sent the first message, who sent the second message, what dates were they sent et cetera. Please think about this before you post things. Please can you clarify the details of that email exchange. Please will you present the information carefully. We are all volunteers here and we have to rely on you to do the spadework
    • I told the DM that the room was not acceptable because of the reasons already mentioned. He informed me that they were full that night and that they could move me to the room next door (would not solve my problem with the rooms location). Told the DM that I could not stay in the room provided for the night so left no option but to leave. DM did not reply and I walked out.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have a Flex Account with Nationwide with a small overdraft facility. I dont use the account a lot and wrote a cheque which I thought I had covered. I was wrong by about £1.75 and for that I have a £30.00 fee to pay.

 

I have written two letters asking for the money back and in the last I said I would go to Court by issuing a County Court Summons for £30.00 plus Court Fee.

 

The last reply yesterday said they would not pay any money. I phoned and said they had till Monday to give me my £30.00 back or I would sue.

 

I had a phone call from a manager at 8.00pm yesterday and she said that Nationwide's policy is never to pay before Court. She said that if I sue they will pay me the money BUT "Nationwide will close my account". She also said something like they will issue a "notice of closure to me".

i'd let them close the account, you said that you don't use the account so would it matter if they closed it?? as long as you get your £30 back, i'd tell them to go ahead :)

I just noticed another £30.00 fee!!

 

Someone posted the Nationwide contact details (solicitor at Swindon) and so I have emailed him.

 

I will sue unless I get paid £60.00 by Monday 22nd January 2007.

 

As for the closure I dont want to have the account closed but I will not be bullied.

Hi ALL!

The Standard Advice is to make sure that U open a "Parachute" Account and transfer all your wages and DD's etc to it before U start taking action against not ONLY Nationwide, but ALL Banks who U intend claiming from.

That way they won't have U over a barrel when, as in Nationwide's case, they tend to CLOSE your account out of spite!

from what i have read on here, they can't touch the childrens accounts, not sure were you stand on your mortgage account is this one of the accounts you are claiming your charges back from, not sure if this is right but don't think they can touch this either, think they will close the accounts that you are claiming againist, how much are you claiming in charges? on how many accounts? i thought they'd be o.k but its maybe cause the account i'm claiming from was closed last year, this is maybe why they are be a*sey with me :mad:

Hi sinking fast!

IMHO

I believe that we are talking about the Closing of Current and Savings Accounts.

For a Bank to Unilaterally close a Mortgage or Loan Account, which is for a predetermined Fixed Term and where the Claimant is up to date with re-payments, would been a Breach of Contract on their part and leave them liable to obvious Legal Action.

I think the rationale with regards your concerns about your kids accounts can be best summed up by redsue in her posts #55 + #57 of her Thread in the following link:

Am looking to see whether I can book her to CLOSE my Nationwide Flexaccount for me as well, when the time is right.

Banks aren't operating an "unofficial" blacklist of people who have claimed are they?

hope they aren't, not heard that before anyway, i was in the BOS today for the first time since claiming back my charges and everyone was being so nice to me, probably got nothing to do with claiming back the charges (they probably don't even know about it) just cause i haven't been in for a while:confused:

still think from what i've been reading that they'll close the account your claiming againist, but i'd just open another account somewhere else, its YOUR money at the end of the day but if because they'd close your account you don't claim back YOUR money then thats up to you, but its just letting them get away with YOUR money!

Banks aren't operating an "unofficial" blacklist of people who have claimed are they?The wording of the S.A.R. Template Letter indicates that U will be Re-claiming your unlawful Charges.

My advice still stands, even if U imaginge in your worst nightmare that Banks keep a "Blacklist" of Claimants...

Open a parachute account BEFORE U start the Re-claiming process!

 

Why would U want to keep ANY accounts with a Bank that has been trying to rip U off personally???

The fact that Nationwide is still technically a Building Society makes it even worst.

...They should exist for the benefit of their Members...i.e...YOU

Yeah, the fact that it is a Building Society really bugs me, and especially as I have Kids savings, mortgage and house insurance with them. Unfortunately, is there any bank which will not try to fleece us? Any that have a sensible policy to unauthorised O/D and returned DD or S/O's?

 

My mortgage is a 10 year fixed rate, which I am blessed with having in these days of rising interest rates.
