      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I am not sure if this occurs with you but something strange is happening with the above links, they both link to the same place, i.e. the New Strategy, anyway the other link is this:

As to the new strategy, then yes post 2 is significant, but it is helpful to read some of the follow on posts as they will probably answer any questions you may have.

Popping into town later to collect my contact lenses, buy a paperback guide for FFXII, get my dogs stiches out (lloyds could hav settled rather than defended, then it would have made the £378 vet bill easier to pay) and drop off my AQ at Derby Court :D

- Contact lenses ok

- The dog got her stitches out fine but she needs a check up on saturday just to make sure she is ok;

- No paperback guide for FF12 til 3rd March,

- Derby courts shut on a saturday! Sigh... I wanted to pay by debit card, but hey, i guess i'll have to post it monday with a cheque... more delays (mumble mumble, grumble winge)

Just rang the court, they got my AQ on Tuesday, so the cheque will have been banked then. LTSB have sent their AQ in and it will go to the judge early next week.

 

She said there is a bit of a backlog at the moment...

Rang the court, it went to the judge on the 6th March and he made an order on the 8th, so i should have it in 5 days time...

 

its taking longer than normal because there is a backlog of claims ***Chortle***

Oh lord! Got an order dated 16 March, my court date isnt til 12 june...

 

If LTSB dont like it they can apply to get it set aside / varied / stayed within 7 days. Which i assume they will do :(

 

I have to send in a schedule, statements, evidence and legal docs / cases. Im assuming this is the court bundle? I have 28 days.

 

They have 28 days after this to send in contractual docs, whether these charges are not penalties and why, whether the charges are in fact pre estimates of losses incurred by me / breach of contract, witnesses, copies of cases etc. They got 28 days too else it will get struck out.

 

So it might be before 12 June providing all my stuff goes in (which it will by the end of the week) and they cant provide theirs...

 

... its one big waiting game isnt it... :(

The court date is quicker than usual, I have not known Lloyds attempt to get orders set aside, indeed they cannot manage to do anything in 7 days.

Its quicker!? WOW! They must be REALLY busy LOL!

 

I'll have to wait til later now to type up the order. Ive had to take my dog to the vet again as she isnt breathing properly so Ive got to get to work. I'll do it later though.

 

And I like the sound of them not being able to set it aside! Great! So basically, if i send everything in by Friday, LTSB have 28 days from the 23rd March (i.e. 20th April) to send thier stuff in else it gets struck out!?

OKIES! I am doing my court bundle now.

 

I have got everything together, but have query about statements. From before Nov 2001, i have a copy of the statement LTSB sent me in my SAR. From Nov onwards its just a list of charges. Will this suffice as they arnt on LTSB headed notepaper or anything, or will i have to print off each statement from tinternet online?

Well, not heard anything yet. Not that I am expecting to but if SCM dont send me their bundle by (say) 23rd April, that means their defence is struck out. What happens then?

 

Do I need to ring the court? Is it all automatic from the court?
