      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all, spent all day yesterday going through all the info in the forum with regard to excessive bank charges, Came as quite a revelation actually!!!.

 

Like I explained in my newbie post yesterday HBOS has been blasting me with charges for years now and to be honest have left up to my neck in the brown stuff on more than one occasion:mad:

 

So have now decided to go and kick em where it hurts, (what goes around comes around!!!!)

 

Have sent off my Subject access request this morning, T minus 40 days and countin, time to stand and fight or die tryin:)

 

Will keep everyone posted on developments and good luck to all others going after Em!!!

Been looking through this Scotland forum for a good few hours now, really is an eye opener! So I've decided to go for it too!! First thing 2moro the RBS are getn a letter and a £10 cheque. Gimme back my dough! haha

Hi guys, had a look at the cases, my mind is def made up now going for it!!! Been a little apprehensive since lobbing my S.A.R - (Subject Access Request) in the post yesterday morning, but feeling a little better now.

 

Very interested to see how much the bank has bled oot me through the years I recon it'll be a couple of grand anyway!!!

 

Any help with this process would be a great help and will keep all posted on how it goes.

Can anyone shed any light

Hi all, just an update on what's all been happening since I last posted, Got letter the other day saying statements have been ordered and will be with you shortly,

 

Well they've been quick, arrived today incomplete!!!!. Have been given statements from jan 02 to april 04, but 05 and 06 have gone wayward, will I wait a couple of days, or send them another letter asking for them??.

 

Anyway I've added up all the charges on the statements I have and so far it's sitting at 900 quid!!!! and still have 2 1/2 years worth of statements to come!! A little shocked didn't think they'de managed to swindle that much off me in such a short space of time.

 

Oh well pay back time is coming.

Hi all, just and update and a couple of questions, I finally got all my statements today and have spent all evening going over them, The tally stands at £1691.00 in charges to the 7th jan this year!!.

 

Firstly what's my next move from here as it's above the £1500 summary cause limit, and i'm a little confused on what to do, split them and risk losing the second half or, I dont know help!!!!!!!!!!!,

 

I want all my money back from these robbing, I 'll leave the second word out if thats ok! What do I put in my L.B.A ask for the whole lot back bearing in mind the limit through summary cause or ask for a reduced amount through splitting it up by date etc, Any help with either question would be of great help as I want to get the LBA in the post by the weekend, Enough is enough Time to fight back found the amount taken from me a little steep, it may not be life changing money but it's a small fortune to me.

I can only tell you what I did. I posted the LBA asking for about £1650(without interest) to the BoS. (amount similar to yours)I got no reply so I filed a Summary cause for £1500 plus interest plus costs and a small claim for the rest plus interest.

 

I attached a letter with the the initial demand for 1650 to both my Sum cause and small claim.(copy of same letter) I asked the board if this was the correct thing to do but with no replies. So I carried on and the Court Clerk seemed to have no problem with it(I asked him and he said it was fine)

 

Don't know if its correct:confused:. Just the way i did it. Filed the court claims yesterday. Seemed to go fine though.

 

Maybe someone with more knowledge will comment.....
