      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

If dotty wants the thread closed, then I don't see that being a problem. If it is likely to continue to be a useful discussion thread that seems a shame.

 

I very much advocate everyone having a right to an opinion and should be free to express it, but I would like to request that you consider the interests of CAG and the people who use it for help.

Guests can also be people who may be looking for information to help them save their homes. If we hide threads like this people who need help won't know that there is help there, and people in the same situations as themselves.

 

Sure they can register, but if they can't see that there is help here then why would they bother.

How do you know who guests are?

 

I certainly wouldn't advocate the use of PMs and emails as there is no way for it to be checked, or for people generally to add or take from it. It defeats the point of the forum.

 

Part of the benefit of posting information is that people can discuss the pros and cons of an argument, or even play devil's advocate, thus allowing them to be better prepared when they get to court for whatever argument is thrown at them there.

 

This issue has been discussed on this site many times before, for example with the Cabot Fan Club, and more recently in the bailiffs forum.

 

I understand where you are coming from, but frankly this is off topic to the original thread and it's past my bedtime.

Hi all,

an update re capstone they rang today and said that they will not accept my arrangement to pay monthly amount due plus £50 because of my most erratic payments over the last year. (i have missed 2 payments).

Just a question, last year my case was adjourned with liberty to restore, however i have a letter from the court saying if it is not bought before the court by 8.2.10 then capstone need to start proceedings from scratch. Now my court date is 15th march so does this mean they have not followed procedures or because they applied for the case to go back to court before 8.2 10 is this ok.

 

I asked for some up to date info and they said i can only have it if i pay £35. I have had no current info from TLT only a letter saying when the court date and time is.

 

Your help would be very much appreciated as i don't know what to do now as i was hopeful that the arrangement would be accepted. If i don't get any paperwork can i contact the court before to request an adjournment or do i still have to turn up.

Court action starts that day that the claim is brought, not the date of the hearing, so it makes sense that their application would need to be before 8th February, but the court may allocate a later date for the hearing.

 

Who is asking £35 for paperwork? This seems unreasonable and if they refuse it, I don't think the court would be happy with this. If they ring again refuse to talk to them (unless you can record it), and tell them to put everything in writing so you have a record for the court.

 

Unless you have good reason for an adjournment, which the judge may or may not allow, you really must go to court as no-one else will fight your corner, so you are highly likely to lose.

 

In the meantime, if you can afford to make up the amount that you have missed over the last 12 months before your court date it will look better for you. You really can't afford to miss any more payments though, either now or in the future.

Hi EIE and Caro,

 

Thanks for taking the time to respond to my message i would like to know what steps i need to make now. The last time i went to court, the judge said he was not happy that the figures did not tally and adjourned for a later date but stressed that only he wanted to deal with the case. How can i build a case when they will not even let me have current up to date figures of the amount they are taking me to court for. I have had a letter saying they will not oppose a suspended repossession order if i maintain an arrangement. BUT they will not allow me to make an arrangement but keep charging me £115 a month so i can't win. So what do i do now when over half of what they alledge is arrears is actually charges.

 

I am getting very stressed by it all now i don't know how i'm going to get time off work (i work in a school) to even go to court.

 

Do you have a thread about your situation and progress to date? If so please can you provide a link as it will be easier to follow than picking out posts on this thread.

I battling with time and conflicts of advice ! I started editing the n244 down last night to confine it only to what Ell-enn and you suggest and although I did cut out all unnecessary words it was still about 650 words.

 

BUT the bloody thing did not yet include some other legitimate references as suggested by enough is enough and you. Am about to get at it now to complete it so as to file by 4 pm today.

BUT, interestingly I seem to have found what may be the answer to all our prayers. A bunch of people that if they are what they have just told me they are, specialise in going for the brokers and lenders mis-selling.

 

 

They seemed to think my statements should paint a comprehensive picture of the whole case and various points on which the eviction should be stayed as I did include in my original statement. they said they were going to phone me back within a few minutes with a more accurate view from a solicitor.

 

Have a look at their website here. they tell me they are a 'bunch of entrepreneurs who are NOT solicitors,but they employ solicitors and other professionals to put mis-selling cases together on a no win no fee basis.

 

I am, OF COURSE, cynical and they may be rip off merchants. But the guy I spoke to did sound convincing. See what you think !

 

Why would you want to pay "entrepreneurs" to employ a solicitor. Why not just go straight to a solicitor yourself on a no win no fee basis if you want to do that.? Frankly if they're on facebook and twitter looking for business it doesn't inspire me with confidence!! What purpose do these "entrepreneurs" serve?:rolleyes::wink:

WHERE ARE AL OF YOU? I am selling my home of 17 years and dont know of yet if we can rent? ALL my house is in boxes with nowhere to go. we may be homeless if we cant get rented Tennants agreement pending fo me and my husband 19yr old son 22 year old daughter nad her boyfriend who knows our situation 30 yrs old ALL ON TENNANTS AGREEMENT. So if this does not go through can we live with you? Ive put my guts through this site I wont be left on the streets with ALL my family. Come on all is helpful. Have you all gone?

I've looked at your thread regarding eviction and believe it would be better if we try and look at this on that thread. I have no ideata what your solicitor will make of this.

 

As I see it, the main thing that you are concerned about is the roof over your head. Rather than lose your own personal info on this thread can we move here.

Until the site team are able to offer a valid public reason as to why my post was removed I will keep posting similar.We are all fighting the same cause here,not each other and what is supposedly a democratic forum specifically created by its founders as a CONSUMER ACTION GROUP has become apparently an action group with the permission of your adversaries?
