    • Hi All Could really do with some advice whislt return from a stressful hospital visit to my mother i was caught speeding doing 46 in a 40 mph limit, i should have known better i knew the camera was there but visit was very stressful and i switched off, totally my fault the date of the speeding was 13/11/2023 so by the time i received the letter i accepted my indescetion and filled in all the required details on the 20/11/2023 having a clean license hoping  to the speed awareness course. With all still ongoing with my mothers ongoing illness i left it at that and waited on reply but i did not receive anything until 01/05/2024 when i received a return to sender letter with the NIP opened inside and ta sticker with a tick on refused, on 02/05/2024 i then received a Single notice procedure in the post for the speeding and failure to provide information i need to reply asap now because with everything going on i not sent back i have 21 days and can plead online but my question is what do i do /fill in on the form i have not had this before and it's very stressfull on top of everything else going on. i really do not feel as if i have done anything wrong (i have checked everything on form and the address and sent well within timescale) but now i face filling a form in of which i have no idea and do not now what to please either, i will have to fill in the online form soon or will pass deadline so any advice would be greatly appreciated
    • I guess I just have to wait and keep my fingers crossed then that the judge sees them for what they are and strikes it out!  It’s really unfair that these solicitors are allowed to miss deadlines and still get permission to proceed. Like I said, they did exactly the same trick on the set aside hearing!
    • urban myth sadly. it is only written off on their books and as they say, a balance still, legally, does exist. you most probably didnt owe the whole balance anyway as unlawful penalty fees and the the interest they accrue typically inflate a debt to a much greater level. your saving grace here is this was to the original creditor and the fact you've had a default notice sometime vack? so regardless to whatever happens, the debt will vanish from your credit file on the DN's 6th B'day. though that doesnt mean a debt is still not owed and that it wont be sold on. just keep that letter from BC safe. dx
    • Card taken out in 2017, default 2021 or 2020, paying a full and final for me was about me trying to rebuild my life without having a 7k plus debt hanging over me, I am nearing retirement and want some peace of mind, I read the agreement letter and thought this is good enough and doubted that a third party claim would succeed if they tried to take me to court. I just wish Barclaycard would say thank you sir matter is all settled now rather than trying to maintain that a balance exists, even though they say I do not need to pay it.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello everyone, this is my 1st post of many to come I imagine. After speaking to my friend who has recently succesfully claimed all (over £900) of his bank charges against HSBC with almost no bother at all, I have today sent the fist letter to the Woolwich requesting all of the bank statements for the last 6 years. I suspect my claim is going to be around the 4,000 to £5,000 mark so its got to be worthwhile. My friends final letter from HSBC with the cheque actually stated on it that it was cheaper to settle then to go to court (maybe if its under £1000) of which they would have won if it had................ I have sent my letter to the follwing address, does anyone know if this is correct?

Many thanks and speak to you soon

I sent my first letter to Clacton too, seemed to work. LAthough subsequent letters from woolwich/barclays have come from all over the country! You'll end up at the london Churchill Place address once they realise you mean business :)

Thanks for that the woolwicharejustaloadof, well its been a week since the request of charges and still no communication, but the general posts on this sites are very simular. If I do not hear after the 4 weeks since posting the request do I phone or write again (so I have copies)? And if I do mail, do I send it on the third week prior to the deadline? Thanks again

Hi Goose

as i understand it they have 40 days to send you your statements. They cannot charge you more than £10.If you did not send your letter recorded delivery they could claim they have not received it. So it may be worth sending them a reminder, informing them of the date by which you expect to get the information you requested. Make sure you send this one recorded delivery.

I know from speaking to other people on other sites such as this, that unrecorded mail has a habit of dissapearing.

You must bare in mind that they will try to hang on to your money as long as they can, so be patient but persistent and you will get what is rightfully yours eventually.

I am waiting for the court to send me a date for the hearing, which seems to be happening more often than not these days.

Keep at it Goose:)

OK, looks like the address was correct and have received an acknowledgement, but that is exactly what it was, they have said that they will be back to me within 14 days but have thanked me for my enquiry and that they value my comments. My pleasure.......Will update soon when I gety feedback

OK, Summary received but I think I must have been a bit over exited when I quoted £4000. It has actually came back 1 a single 1 pager summary at over £1700. Still not a bad amount. Anyway, the 2nd letter is in the post winging its way over as we speak. Will keep you posted. Now its starting to all happen

Hello everyone, as I mentioned in the earlier post the 2nd letter is now on its way, but am growing more and more concerned about a few things

1. Woolwich freezing my account

2. Woolwich serving a default against me

3. Woolwich closing my account

3. My overdraft with the woolwich being demanded back

My question is: as I am in the flow of things at the moment, is it best for me to go all the way to the court demanding that no defaults are served and can the FOS do anything about them closing my account and if they can, can they do it quickly

Goose contact a mod as far as im aware the woolwich cant do anything with your account while its in dispute also your default removal can be made part of your settlement , having read numerous threads i didnt think the woolwich were reverting to these bullyboy tactics !

if my advice has been of any help to you then please click the scales ! Thank you :D

Paddy, thanks for your help, I think you read some things on the threads which make you really confident, and then you read just one negative and it seems to throw it all in the air again. But I think the general trend is to stick to your guns and all will be OK. Thanks again

OK, my 2nd letter with total amount was sent on the 23rd November and today I have received a reply. It is a standerd letter saying that they are sorry I am disatisfied but they will resolve the matter by the 28 December and its not even signed (its a photocopy signature). Do I wait and give them the opportunioty to respond or send the LBA 14 days from the 23rd (when the 2nd letter was sent)

Send the LBA 14 days after the prelim.

This is all part of the woolwich's delaying tactics, make them work to your timetable, not the other way around. if you let them dictate the timescales they will string you along for years with you never getting anywhere!
