    • If you look at some of the other debt related threads will see that one of the first things which will be asked will be for you to list out your debts in a brief chronological order, including date of debt, amount, creditor, amount outstanding, defaulted – yes/no – date of default, date of last payment made, have you acknowledged the debt at all to the creditors. That lot at least. I expect that my colleague @dx100uk will be along but will meet to know at least that information
    • Hi, I have found this group very helpful hence I am here seeking help and advice.   I got myself into a situation where I have now more than £50k in unsecured debts (personal loans & credit cards) and things are now getting out of control as I am struggling to make payments. This is purely my own created situation and I am taking 100% responsibility for it. I am keen to get out of this situation as soon as possible hence I would appreciate any help and advice in this process. I am employed at the moment and don’t want to risk going into IVA or bankruptcy as this would risk losing my job. Being sole bread earner of my family, I cannot afford to lose my job. I have been trying to keep up with the payments so far and had few missed payments instances until 3/4 months ago but got caught up with missed payments somehow using my savings. All my debts are still with original lenders. However I know I am getting into same situation again shortly and won’t be able to get out of it again. I have started exploring Debt Management Plan (DMP) option through StepChange but haven’t submitted it yet. Based on budgeting, I have around £820 available to make payments to all lenders after taking care of all other essential expenses. This is definitely lot more affordable than what I am currently paying to different lenders. 1. Is DMP right option for me in current situation? 2. what are the negative consequences of availing DMP? 3. is there something else that I can do to get out of this situation? I’m determined to clear out all my debts but need bit of breathing space and time. Let me know please if you need any additional information. Thanks in advance for all your help and guidance. MM

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Was wondering if anyone out their could shed any Light on this please

 

Family friends Husband has had to go into a nursing home so the council have informed her that she should apply for pension credits.

 

When she rang them they asked for her savings details which she gave and then they advised that she would be be entitled to some pension credits but before they could process the application that she needed the last 3 months statements in front of her and has 30 days in which to get them for the 3 accounts appertaining to here savings

 

She then asked would she not be better off sending them a copy, to which they stated no so long as she had them in front of her when she rang back then that would suffice and it is only under certain circumstances were they may ask you for a copy of them.

 

Which begs the question how do they know if people are telling the truth or not as regards their savings if you don't need to send them a copy of your statements or do they have access and the authority to get this information.

For most Pension Credit applications, they don't really need sight of the bank statements provided that the total savings figure is below £10,000. They rely on the claimant's honesty. I have never had to supply details or proof of our savings either. Just confirmation that the total is under £10,000.

I suppose they could do a spot check but I doubt it. I had an in-depth review in June this year and didn't send any proof nor was any asked for.

Why would you want to lie about the level of your savings? I find most people are totally honest.

 

 

Pension Credit applicants are in the main in their 60's and above. The DWP do not put them in the same category as younger claimants that claim JSA/ESA or IS.

Whilst I understand the gist of what you are saying I think you would be surprised at how many people do not tell the truth when it comes to claiming state benefits, that is why I was asking the question do they have any system in place where they can check what finances you actually have other than you telling them over the phone or sending in statements, otherwise I just think it is a bit of a ad hoc system, don’t get me wrong whilst I fully understand that there are people who cannot save due to their circumstances, then there are people who don’t want to save, then there are people who do save but then why should that be detrimental as to what pension credits they receive, they have worked all their lives, been cautious and saved some of their money so why should they then have to live on it, would a fairer system not be that they all get the same amount of pension credits.

 

I mean the lady in question here is not a millionaire or anything, in fact she is only just above the amount you have quoted, thankfully I am nowhere near retirement age yet but it begs the question is it really worth saving any money for a rainy day.

 

Wouldn't surprise me in few years time, that if you have a private pension then you will be expected to live on that and not get a state pension or just get part of a state pension to top it up.

 

Just my thoughts.

There are two systems in place. The DWP/Pension Service can put you on notice to supply the statements if they think the claimant may have been a little economical with the truth. If the statements aren't sent in they can suspend/terminate the claim.

The second is that if they think fraud is involved, they have access with the bank direct to get the info.

 

 

As I have said, we have claimed Guaranteed Pension Credit for the past 5 years since I was 60. I/we have never been asked to prove what is or was in the bank/purse/under the mattress etc. They have asked for proof of our many pensions, but not the capital held.

 

 

Part of what you say I do agree with. Our Pension Credit award is reduced considerably by the amount of our private pensions. If we didn't have these pensions, then the Pension Credit would be higher. We get no more than someone who has never saved or invested in a private pension for the Guaranteed element, although we do get the max savings element of just over £20 a week.

 

 

Should people spend, spend and spend? I would have done with what I know now, but then if you have to rely on a benefit for your income, that benefit can in the future be withdrawn or reduced. They can't touch my pensions.
