    • Hello, After seeing all of the posts about BMW on here I really wish I hadn't even considered them! I bought a used car from them over the weekend, one specifically which had a reversing camera and cruise control in the advert. I was foolish at the time of purchase and didn't check to see these functions work on the test drive (totally my fault). Now that the car is home I've checked and checked and neither of these functions are available. I even checked on Parkers and it seems that no Skoda Kamiq '21 models come with any parking cameras at all. When buying the car, I was told all that was needed was 'Four signatures and £500' to secure it. I was never shown any of the documents, and instead the sales rep opened a box on his iPad and asked me to sign. He had been complaining about the length of time some customers take these days all throughout my time with him. (Again) foolishly I signed. In my email inbox I now have four attachments from BMW, one of which is my signature under a letter which says that the cars don't need to match the advertisements online, or have any of the features that a sales rep talks about. I realise that I've made mistakes in not doing my due diligence here, but thought I might as well ask the experts here if I have any rights left to claim that the car was miss-advertised, or if I unknowingly signed them away?       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I am so sorry that you have lost your dog. You must be broken-hearted. She was lucky to have such a wonderful owner who cared so much for her.

 

You won't be charged with fraud, so please don't worry about that.

 

I don't know enough about the payday loan companies you have listed, but others will be able to advise you. Some will scream and yell and others will be more reasonable. If they cause you too many problems we can tell you how to deal with the harassment and get them to back off.

 

Step Change can be helpful because they tend to keep DCAs/creditors in line. How much is outstanding on the Step Change dmp?

 

Please don't worry. All the payday loan companies know they can't actually get money you don't have.

I don't know if StepChange will kick you off. You could explain the circumstances and hope you speak to someone who understands and is sympathetic. After all, you didn't realize your vet's fees wouldn't be covered. You are a lovely person and you did the best for your dog.

 

You could then ask for a second chance. If they do kick you off you can start threads here for any of your creditors who won't continue to accept the agreed payments and we'll advise.

 

I think it's highly unlikely that the payday lenders will turn up at your house. They may threaten to send someone, but if they do we can give you a letter to send, warning them they will be trespassing. Let's worry about that later.

 

You probably don't want to risk upsetting your dmp, so the best thing is probably to email the companies and say you can't pay back the full amount. As there are six of them and you say you can afford £80 per month between them, I would offer them £10 each to start with and ask them to freeze the interest. That way you'll be able to see who is difficult and who, if any, might be reasonable. However, StepChange might be more effective in getting them to freeze the interest so you may have to go to them ultimately and hope they'll sort it out for you. I'm sure you won't be the only person who has taken out payday loans while on a StepChange dmp, and they are a charity so I would think that they do give people at least one second chance, especially in circumstances like this.

 

It probably is a good thing that you have closed your bank account as payday loan companies are notorious for helping themselves even if someone has tried to renegotiate the agreed payment.

 

Just take one step at a time.

It's probably best to phone Step Change - You'll then at least speak to someone who can give you some immediate advice.

 

Do you have to pay for the plan with Money Expert? Please forgive my ignorance here. If you do, then I would leave it.

 

If anyone turns up, and mostly they threaten to but don't appear, then you can hand them the "Doorstep" letter and tell them to go away. They have absolutely NO powers, no matter what they say, and you don't have to speak to them.

 

If you go to 'Library' at the top of the page and follow the directions to the debt letters you'll find it.

 

If they write to you saying they are coming, send that letter by return, or by email.

 

Don't panic, and hang on until you have got an answer from Step Change.
