      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Yes, it seems as though this is the latest ploy from dear 'ole Mr Higley and his team. Gone are the days when a somple 'bog-off' letter was sent...ah, the good 'ole days!!!!;)

If you choose to go direct via your local court (as have I), then you do not need to hand them in, posting is allowed:)

 

Of course you can hand write them, but once you've given your computer a hefty kick and it is beginning to play nice, then it is much easier to meerly copy and paste the templates onto the court forms via their website. The only thing is that you are unable to save any of the completed forms onto your computer. you will need to ensure that you make enough copies usually three (one for you, the court and cobbetts).

Yes, you can add any extras up to the point that you file a claim with the court/mcol. Simply add them to your schedule.

Please note that once you have filed your N1 claim form, you can no longer update your schedule with any 'new charge's they happen to plonk on.

These will have to be dealt with later on, as a new concern, but the good news is that apparently it's a lot less hassle;)

Sounds like the nonsense I received from them.

I opted not to respond unless the judge actually requested it, after all, he is the one whom you listen to, not them, the scaremongerers:mad:

Up to you honey what you decide to do, but I didn't fall for these tactics and I still won.

I'd wait n'see, if the judge requests that you 'extend your POC' feel free to pm me as I have a tried and tested template (from westy) that you are more than happy to use and adapt where necessary.

thanks muggins!! can i just ask the letter I got from cobbetts didnt say what it was it just said defence at the top and which court it was at, also just telling me that a copy had gone to court then it went into all the stuff i said above so is it a cpr18 request cos you said in your thread you didnt get 1 but got nearly the same letters as me?? should I just go on a do an AQs aswell and send it off so its done? cheers..

 

No, no do not go ahead and file an AQ until the court instructs you to do so.

 

Simply send Cobblers a two sentenced letter acknowledging that you have received a copy of their defence as it is only polite.

 

The court will also send you a copy of their defence with a Notice that a Defence Has Been Filed along with an Allocation Questionnaire and or an order to further particularise/ extend your claim. They will advise you when you have to complete it by and where to send it and what fee to pay.

 

Regardless of whether or not Natwest make you an offer, the court will then issue you with a Notice of Allocation to the Small Claims Track (Hearing) this will advise you when to send in your supporting evidence or court bundle.

 

Hold off doing anything until you hear back from the court. Until then by all means download the template onto word and get it ready for when you need it.:D

You are correct, if the judge wants further info then the court will advise you.

As for acknowledging Cobbetts defence, it is only polite and is by no means compulsory, so don't worry.

Hi guys!! just thought I would let you know I WON!!!

i received I cheque this morning for the whole £2907!! so straight to the bank on monday morning however it did have the same cobbetts crap in about how they still thought they would win and that I should agree not to disclose to any third partys!!!
