On the 15th December 2011 i took my elderly staffie for a walk aas we were walking on a piece of grass at the side of the road there is a big house opposite with electric gates,as the gates opened this massive akita trotted across the busy road and grabbed my staffie and shook him like a ragdoll i was screaming art the owners who by the way was watching this attack to recall her dog after 10 minutes the dog trotted back and was greeted to the daughter who patted it

they didnt even have the decency to ask how my dog was they just closed the gates and went into the house.

When i arrived back at the house i reported this dog to the police as the house is next door to infant school the police came out and took a statement we then noticed Porridge(my staffie) was bleeding from his chest so rushed himm into the pdsa where they had to operate and repair his chest muscles and put two drains into his chest.

I sent the vet bill to the owners for them to pay for the vet bill its the least they can do they wrote me a letter back saying that the printout wasnt good enough they wanted a proper receiptt so they could claim back Vat on the bill

Now this is where i have messed things up

Cos i couldnt get another letter of the PDSA i have stupidly put it on another vets invoice and now have been found out cos the owner went to the vet to pay the bill and obviously found out they didnt have that invoice!

I feel totally ashamed i onlly did it for justice for porridge and why should the PDSA be out of pocket cos of this iresponsible dog owner

no monies have been accepted by myself i would not have kept the money it would have gone straight to the vets

I went to straight to the police tonight to tell them what i have done and someone is supposed to be getting back to me

I have absolutely ruined everything as we were due to be adopting this year but not now after this

im not looking for sympathy im just wondering what ill be charged with is it fraud?obtaining money by deception

Do the PDSA charge, as I was under the impression they ask simply for donations?

Try not to worry - I'm sure your heart was in the right place. However, I doubt the other dog owner will want to leave it there (would you?).

''A deception will be deliberate when the defendant knows that what he represents as true is untrue. This is predominantly a subjective test, matching the general approach to establishing intentional behaviour. The test of recklessness is also predominantly subjective to show that the defendant is aware that what is represented may or may not be true, excluding the extended meaning of recklessness in R v Caldwell [1982] AC 341.''

However, you haven't actually 'obtained' any money - you 'attempted' to. It may be found that No Further Action in this instance will be taken. You may just receive a verbal or official reprimand.

Why don't you wait and see what happens, and then take it from there?

thanks phil no they dont charge but they gave me a printout of the running costs for porridges treatment and i thought their dog did the damage why shou;d PDSA be out of pocket

I just wanted justice for him not to rip anyone off

Essentially, the Charity has lost out. Instead of trying to recoup the treatment costs on behalf of the Charity, you tried to purloin those funds for your own benefit. At least, that's how some cops and maybe the beak would see it.

Maybe that could be your act of penitence - to reimburse the Charity out of your own funds?
