    • If you have not kept the original PCN you can always send an SAR to Excel and they have to send you all the info they have on you within a month. failure to do so can lead to you being able to sue them for their failure.......................................nice irony.
    • Thank you and well done  for posting up all those notices it must have have taken you ages.. The entrance sign is very helpful since the headline states                    FREE PARKING FOR CUSTOMERS ONLY in capitals with not time limit mentioned. Underneath and not in capitals they then give the actual times of parking which would not be possible to read when driving into the car park unless you actually stopped and read them. Very unlikely especially arriving at 5.30 pm with possibly other cars behind. On top of that the Notice goes on to say that the terms and conditions are inside the car park so the entrance sign cannot offer a contract it is merely an offer to treat. Inside the car park the signs are mostly too high up and the font size too small to be able to read much of their signs. DCBL have not shown a single sign that can be read on their SAR. Although as they show photographs which were taken the year after your alleged breach we do not know what the signs were when you were there. For instance the new signs showed the charge was then £100 whereas your PCN was for £85. Who knows, when you were there perhaps the time was for 3 hours. They were asked to produce  planning permission which would have been necessary for the ANPR cameras alone and didn't do so. Nor did they provide a copy of the contract-DCBL  "deeming them disproportionate or not relevant to the substantive issues in the dispute" How arrogant and untruthful is that? The contract and planning permission could be vital to having the claim thrown out. I can find no trace of planning permission for the signs nor the cameras on Tonbridge Council planning portal. and the contract of course is highly relevant since some contracts advise the parking rouges that they cannot take motorists to Court. I understand that Europarks are now running that car park which means that nexus didn't  last long before being thrown out.....................................

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

WOW - Mind boggling but slowly making sense of it all - seems common sense when you do:confused: . Bear with me folks:-)

 

Started this on behalf of my fiancee based on Which? magazines articles. Used their 'letter two' as we had the last 2 years of bank statements to go on and that was the worst time. Have sent that letter claiming back £1995 in charges (also, not claiming but mentioning the £407 interest) from a recent 19 month period.

 

However..........

 

It now seems I did not calculate charges correctly based on info read here in last few days, I did not send schedule of charges either....ooops. Letter was dated 5 Sep 06. Nor did I say they had 14 days to respond. I'm wondering if I should now go straight to LBA as this will correct earlier, small, mistakes. They would still have had a chance to respond to first letter regardless of slightly misleading contents and, hopefully, the new LBA will be spot on correct.

 

I have spent time reading all the FAQs and other stuff - all very helpful thanks.

Just wondering if my gut feeling, to go to LBA at 14 days from 5 Sep (inc spreadsheet of correct charges claimed), would be the right course of action??

 

If anyone's got time to post advice here i'd be grateful......as would my 3cm 'butter bean' growing inside me (we've decided to take our hormones out on some one more deserving than daddy;-) , ie, NWB).

I'm afraid that as welcome as the Which! campaign is, it is flawed - as you have started to discover.

 

I suggest that you start again. That way you will be sure that most of the pitfalls are avoided.

 

It will only put you back a couple of weeks or so but at least you will take control of the process

Thanks guys (Cillitbang - is that stuff any good by the way????:p ). I was about to start my LBA today in prep, but will go back to prelim letter as it does seem more applicable.

 

However.........all change.

 

We just got a letter this morning from the Customer Care Team at Credit Management Services at NatWest!!! I should mention the account is currently £2600 ish o'drawn (£2400 of which is interest and charges from last 19 months).

 

I rang them straight away but they have not had a chance to look into it yet, the letter states:

 

'Initially, let me thank you for bringing this to my attention, as it is important we are made aware of any instance where our customers feel we have fallen below the standards expected of us.'

 

I doctored the Which letter slightly, I went on about how shocking it was that asuch a large institution had such an irresponsible attitude towards offering help and advice to their account holders when clearly in trouble...let alone making it exponentially worse with the damn charges.

 

'As part of the customer care team, I have read your letter carefully and I am currently investigating the issues you have raised. I will be in contact again within ten working days to provide you with either a full response or further update of my investigation.

 

I will do my best to resolve your concern quickly. To make you aware of all the options available to you I have enclosed the leaflet entitled 'Customer Complaints - making things better', which explains how we would handle customers' concerns with NatWest.' ......... not helpful or applicable in this case.

'If you would like to contact me in the meantime'.....blah

 

Hmmmmmmmm....... I thought. I rang them. She hasn't looked at it yet so couldn't discuss it (also hadn't recieved the letter authing me to act for him yet....handy!! not!).

 

I mentioned the course of acton I thought we may need to take, but said I would not start it until we had discussed things. I guess that won't hurt as it's all gonna happen anyway - the worst that can happen is it delays things slightly. My fault really, for going the Which route, but you never know, I suppose I've got to give them a chance to at least attempt to reslove the situation.

 

Thoughts please............should I now put this thread into the NWB bit? How do I take it all over there? Or do I have to start from scratch??

 

Bankfodder, have you had any correspondance with Which? I think I might write to them otherwise (I have e-mailed Emma B there a couple of times and she was helpful), they are trying to help but I think pointing people in this direction would make life easier for everyone. Thoughts on that please??

Agnews- have you got 6 years statements? If you have don't worry because you can start again. The response you will get is the likely "applied fairly" "transparent" and "in accordance with terms and conditions". No need to worry, if you have 6 years great you are at least on your way to your money back.

Hi There - ive read all your stuff and really think you should start again.

 

Go through your last 6 years worth of statements - if you havent got these use the Data Protection letter in the templates library. Add up all of your charges plus any interest charged to you. (This interest is only claimable if the banks charges took you overdrawn - alot of people dont bother as it is very complicated and doesnt usually add up to much)

 

Edit the Prelim letter in the Templates Library with your own figures and account numbers and send of to 135 Bishopsgate address. Wait 14 days for Natwests reply and then your at the LBA stage.

Well ive been looking through your thread and im inclined to agree with everyone else.

Back to the drawing board, do a SAR then start a thread in the Natwest forum so we can help you along the way.

I suppose if it's worth doing at all, it's worth doing properly. S.A.R. Here we come. You never know, this person at Customer Services might be able to help with that one - or is that a bit 'pie in the sky'. NatWeststaffmember (thanks for your thoughts - you're no doubt right), what d'ya reckon?

 

I'm still gonna attempt a meaningful dialougue with her.........watch this space and I'll let you know what happens.

 

One more question though, you say the interest is only claimable if the charges push you overdrawn. What if you have a £1500 limit at a low rate and then you go over slightly (incurring masses of interest), and the subsequent charges make it nigh on impossible for you to get back? £2-300 in 7 days on some occasions. Interest then remains at stupidly high rate and you keep getting charged because of charges....aaaaggghhhh. Aren't they naughty. I guess no-ones case is straightforward but I don't wanna balls it up from the offing.???

 

I'll get the S.A.R off and see what comes of Miss Customer services.....my butter bean will be as big as a lemon by then....maybe bigger if it's not twins......agghhhhhh!. Then we'll need 6 years worth of money:shock:.

 

Good luck with all your different cases, I'll keep an eye on your progress in the meantime. With a view to nicking your ideas;). I think I miss this already:oops: .
