      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

not sure if this is in the right place as im new so sorry if its not!

 

hi people i really need some help and advice.

i have 5 catalogues and have been charged ridiculous amounts of late payment fees over the past 2 years but more to my horror i have been getting charged2 sometimes 3 times a month for

1.late payment fee

2.being in arrears on the account

3.for them sending me a letter stating i owe them money

now to me being charged £12 to send a letter through my door is absolutly ridiulous. i have rang all 5 catalogue companies asking to send me all my statements from all accounts from statement 1 to the present day and have been told its going to cost me £25 to receive this information.

i basically want to know can i recaim these charges and if so how do i go about re claiming them.

if anyone has a link to a form that can be filled out online this would be great.

been reading through a few offers to try and make sense of what i need to do as dont want to be mithering on here LOL

 

that links for the prelim is brilliant thanks, hopefully will get it all sorted just in time for christmas.

 

the reasons for some of their charges is ridiculous and am so not happy but i am not one to leave it so lets hope it goes in my favour.

i have a catalogue with 5 different companies and i applied for the accounts online and did not sign anything.

does anybody know if i have a credit agreement with them or not as i believe i havent due to not digning anything.

 

need to know asap plz

i have 5 catalogue companies and am in the process of awaiting a reply from them after i sent a sar letter to them.

 

i have been asked that under the catalogues terms and conditions about the charges was it stated what charges i was going to get.

to be honest i dint read the terms and conditions to do with charges.

i ticked the box online when i opened the account and agreed to the terms and conditions so will this affect me re claiming any charges back as i have been getting charged £36 a month in charges and still feel this is wrong and unfair???

well basically i have been getting charged 2 sometimes 3 times a month on my catalogues these charges have been for

1. missed minimum payment

2. late payment fee

3. debt collection telephone call

4. sending me a letter

5. being in arrears on my account.

 

every month i have rang them and tried to explain that i can only make the payments when i get paid and unfortunalty i get paid after the date they want their payments. i feel being charged £36 a month is absolutly ridiculous and being charged £12 to send a letter through my door is a joke.

 

i have sent them a subject of access letter asking for all my statements i know that i have had one catalogue since 2008 and they can only tell me of charges dating back from 2009 and that has totalled to £144 so god knows what the year before charges were and wht charges total upto on all 5 catalogues.

 

i am awaiting reply from the sar letter i sent them and once they have sent me my statements i think i need to put them on a spread sheet and send them a preliminary letter

 

i need to know though if ticking the terms and agreements box could possibly affect the proces of me aybe claiming these charges back???

i need advice on what to do next.

 

i have been charged ridiculous amounts of money from my catalogues what i have and i have sent them a subject of access request letter. i sent the letter recorded delivery and when i checked the royal mail tracking it confirmed the letter had arrived and been signed for. now the companies are saying they havent had the letter and have passed my case on to find out about my query. this was 2 weeks ago i have e mailed them and rang them and there denying even getting the letter.

 

i want to get this sorted and try to claim my charges back but im getting nowhere with them what do i do from here?

i have now received my subject access request information from all my catalogues.

 

i have added up all the charges and would like to know where do i go from here?

also i want to know if i am able to claim back any insurance payments and also the monthly interest i was charged on items!

 

any help would be much appreciated.

hi all,

i have now totalled up all my charges and i need to put them onto a spread sheet but i have not got a clue how to use microsofts spread sheet and cannot seem to find a spread sheet on this site. i have looked in the library but there doesnt seem to be one there. please could some one help me i need to get this sorted as its stressing me out and im in the process of moving!

all i have done is put the date the amount and that it is an administration charge but i deleted the section that said 8% as i didnt understand what the 8 % was for.

i have put all the administration charges at the top then totalled it up then underneath i,ve put all the interest charges but i think the interest charges are for the purchases i made but its worth a try.

also they have sent me copies of all statements for 3 catalogues but not for 2 of them all they have sent me is a load of pages with loads of writing on stating my balance minimum payments but not the charges

hi everyone,

right, i have received statements for 3 catalogues but am still awaiting statements for the other 2 catalogues i have been waiting for 3 months in total for these statements now and feel they are just pro longing it. i seen something on this site about who i can complain to and what letter to send the companies because they have not complied within the 40 day time limit so could some one please send me the link for the letter i need to complain please.

i cant find the right letter to send them, the link you gave me comes up with loads of diferent subjects and i dont know what to send them im useless, they sent me a letter stating they were not going to charge me the £10 fee because it had been over the 40 days in which they had to send me everything so they have wavered the fee.

i have now sent the catalogues a preliminary letter to which they have replied basically saying they are NOT going to refund me my charges so i sent them a letter before action letter. i understand that i will now have to take them to the small claims court but how do i go about doing this?

dx i dont know if ur replying to me or laalinz? LOL

all my letter says is there charges were fair therefore they are not willing to reimburse me with any monies i paid to them for charges.

so now they have refused to refund me which i knew they would do what would be the right course of action to take now?

IF it would be to take tothem a smalls claim court how do i go about doing this IF not court action what other options do i have?
