    • The last photo shows the overflow carpark looking at the block which our room was located. When we got out of the car my partner thought that the building was for staff accommodation.  The unsecured bedroom window opened onto this car park.
    • Also I see that you are doing a lot of this on the telephone – and without any written confirmation. This is a big mistake. You need to start taking this matter seriously and so everything should go in writing. If you have telephone calls then they should normally be recorded. Read our customer services guide. You should make notes about every telephone call and then you should send an email to your telephone correspondence confirming what they have said or what they have agreed. It is important that you keep detailed paper trails here. Of course we may be jumping the gun and maybe big motoring world will step up to the mark – but I'm afraid that they have a lousy reputation has you have seen and so you need to start practising survival techniques and protecting yourself. You say for instance in your letter of rejection that the mechanic told you on the telephone that the gearbox needed replacing. Do you have any other evidence of this conversation? This is going to sound a bit harsh – but other people will be visiting this thread as well for their own purposes. You conducted their research about this company before you bought the vehicle. You now are fully aware that this is a company which can be very difficult to deal with and causes a lot of problems for many of their customers and yet you are still taking a telephone/verbal approach. Do I need to say any more? Also one of the documents you put up is an email exchange but it is not clear who is writing to who or what dates. If you showed this email to somebody in a pub they would be asking lots of questions about who sent the first message, who sent the second message, what dates were they sent et cetera. Please think about this before you post things. Please can you clarify the details of that email exchange. Please will you present the information carefully. We are all volunteers here and we have to rely on you to do the spadework
    • I told the DM that the room was not acceptable because of the reasons already mentioned. He informed me that they were full that night and that they could move me to the room next door (would not solve my problem with the rooms location). Told the DM that I could not stay in the room provided for the night so left no option but to leave. DM did not reply and I walked out.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I may be wrong but I doubt they'll start the court action anytime soon. HSBC are already on dodgy ground. Have MBNA issued a DN or TN?

 

 

They've issued a default notice which i will put up for you, they've been sort of happy to accept 50 pounds a month for the time being severe hardship etc... sent letter of acknowledging their termination (final demand..)to helen packwood yesterday..

Thanks babybear! as i've said they've got my mobile number which i don't mind but my wife's health isn't too good to be getting calls at home if they find out our home number!!! If they do i just fire off that harassment letter then? you've both been brilliant to me so far many many thanks...

If you can afford it by one of the 'Truecall' gadgets (about £90) they are brilliant. The calls on my landline were seriously getting me down and I even thought about changing our number. We now don't get ANY calls on our landline - apart from people we want to speak to of course!

just had a phone call from an adam davie at hsbc collections saying about reduced payments? went through some details with him including does my account end in 321etc told him will make a payment on the 30th (am in process of changing accounts.) specified to him not to take any money out as i will send electronic payment ( he said our calls are recorded and we will not take any money out!) what's my next step cos i don't trust these a holes 1 bit?

Firstly - don't speak to them. If you feel the urge to, just tell them your account is in dispute and you want all communication in writing.

 

I wouldn't pay them. You have sent the unlawful repudiation letter. You now need to demonstrate that not only have you written accepting this unlawful repudiation but that also, through your actions i.e. not paying, you further cement your argument that as far as you are concerned the agreement is at an end. If you were to pay them anything it would only be a payment against the arrears that were outstanding at the date of the DN (because legally that is all you now owe them).

 

The decision to continue paying is yours but you need to be careful as it could affect your argument with regard to unlawful repudiation.

Oh not going to pay brooce! just saying that until that account is closed and mines shifted which should be before the end of the month, coincidence that today i have about 6 calls after sending that letter yesterday, just worried about that right to set off thing or can't they do that yet? as i said to the guy i expressly forbid you to take any money from that account etc

Set off could be a problem. Is your current account a joint one? Do you have a HSBC current account in the same name (solely) as the credit card?

no it's joint account she's shifted her wages to her barclays account i've opened a natwest jobbie

 

Sounds like you're on top of the job. That link to the FOS does seem to say that banks can't use set off to empty a joint account to pay one of the parties debts - only fair really.

Amazing how somebody has actually been nice to me from the worlds bank!!! wanted my home number as usual said no chance because of wife's health not having you phone up and upset her!!! As i've mentioned the joint account with the overdraft was the only thing that linked her to me now thats paid off (cheers mum..) we can close that account swop all dd to my new account and they can come after me she'll be safe as there are no debts in her name (apart from mortgage, shared ownership so they're stuffed there for going after the house....) As long as her credit rating doesn't suffer i don't care.... Thats how much they've changed me in 4 months

Ey up mate. I haven't paid them a penny in over 6 months and I'm pretty well at the exact same stage as you (maybe a week or two ahead). Same dodgy DN, same final demand and same letter (got it on the same day as you) threatening DCA's unless I paid. Can't wait for the next instalment!

Well i missed one payment back in december and have been paying em 50 quid a month till now and still got the same cr@p as you!!!!! and 0nly 886.61 has been added in interest etc so if i can get em for the rest of the 8k ( that'll be a bonus.) if not through the courts and 50 quid a month for 10yrs.... either way, and maybe same with mbna must upload their dn for you to see? but they've not sent me anything else at all yet?

Hey broooce how you holding up? any news on your end? Nothing so far here, but then i don't get post till 2 o'clock onwards am sort of expecting the phone calls to start today tho....

 

Just another BS automated letter dated the 28th April giving me 7 days to get in touch to prevent the account being passed to a DCA. The letter goes on to state they are willing to '..come to an arrangement to settle the debt...we are prepared to accept a reasonable final payment from, which is less that the full amount..we will write off a proportion of the debt..'

 

I offered them 15% months ago and they refused it. I'll offer it again!

Normally they want it up front. But I have read of others who managed to negotiate a low f & f and then paid it over installments several months. I think half the battle is getting your letters onto the desk of the right person. All that HSBC seem to send is standard drivel that they issue by the hundred.
