Hi guys, hope this is the right board.

 

I've had ongoing issue since 2006 from Littlewoods not taking fraud in my name seriously.

 

To cut a veeeeeery long story short....

 

 

  • My mum took out items on her friends account who acted as an agent for Littlewoods
  • My mum left and moved abroad
  • The agent then put the outstanding balance in my name somehow
  • I panicked and made 2 payments in 2006 on the account while I looked into it thinking it was a mistake.
  • Spent ages on the phone being bumped around to trying to get to their fraud team. CCA requests went ignored.
  • DCA Mackenzie Hall are now chasing me, nice chap came to the door about 1 year ago who I advised I did not knowledge this debt and explained situation and he left thanking me for my time and not being arkward.
  • Still get letters from above DCA bullies which get neatly placed in the junk drawer and ignored.

I have just checked my credit report online and I've noticed I have a default on my account every month from 2008 to now from Phoenix Shop Direct who thanks to this site have found its this debt. How do I get this resolved? Do I send the CCA request to DCA? Involve a crime number or what?

 

Is it Littlewoods or DCA that I contact to remove the lovely black markers on my credit file?

Report the fraud here Report a fraud | actionfraud you'll be given a crime reference number, send that to Mac Hall and the credit reference agencies, if they pursue make a complaint to Kilmarnock Trading Standards & the OFT. If the CRAs refuse to remove the default complain to the ico.

did you ever have an account with them in your name?

then you cant have a default registered against you at the CRA

 

if you did not have an account why did you make payments?

 

i can see why they would be suspicious!!

 

you need to write to the CRA with a copy to the creditor and point out that you have never had a credit account with these people and ask them to remove the entries

 

write a second letter to the catalogue company asking them to show you proof of an account in your name

I made payments because I was worried about my credit, and because it was my Mum's "account" I wanted to keep it in good stead while I found out what she was doing with it. I've since not heard a word from her, and to be frank I was only 20 then so very naive about it all.

 

I was sent a letter from Littlewoods once their agent passed on my details saying the credit agreement had been put in my name and to sign and date the slip sending it back, I never signed or sent it back.

 

I have just managed to find all my notes from back then and I contacted Littlewoods on 3rd November 2006 after advising them it wasn't my debt and they said I had to continue paying and then pursue my mum for the money I was paying out because they had set it up in my name from the agents name, this is also the date it was passed to the DCA.

then you need to point this out the the CRA and also ask littlewoods to provide the authority for being able to transfer your mothers account into your name without your agreement

 

i would tell them that they face a possible substantial claim for damages if they do not repair your credit files within the next 21 days

 

if what you say is correct i would see no difficulty in getting a CFA (no win no fee) lawyer to take up what would be an open and shut case for you

What does CFA stand for? (conditional fee agreement after googling?) I'm not interested in hiring a solicitor, I just wish for this footprint to be removed from my file.

 

I've just found something interesting while trying to hunt down the process agents follow when a customer defaults...

 

Catalogue firm won't budge on agent debt - Sunday Sun

 

It says

A spokesman said: “For a customer to be removed from an agent’s account we require the following.

“We need the agent and customer to agree the outstanding balance and the customer’s signature accepting the alleged balance.

“We need proof of the customer’s address and signed payment cards. We attempted to contact the customer and letters were sent on three occasions. Unfortunately he did not reply to our letters.”

The agent wouldn't have been able to provide anything other than my name and address! Why have they allowed this to be taken?

As long as Kelly's mum tells the catalogue that the friend was her customer and that the customer can no longer pay up, the catalogue should then send mum a form, which mum will have to fill in and send back to catalogue with as much detail as possible so that the catalogue can then pursue friend, they should then remove that amount from mum's outstanding balance. Especially if friend is ok to make arrangements separately, it should be no problem, I had a friend like this who used to owe thousands on my catalogue, when she left the country, I told the catalogue and they just wrote it off my balance.
