      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I started working for a company >2years ago, and at that time was one of the first in the door of the new office. I did what was asked of me, and had to travel a bit and help transition work into this new office. Since then, there have been a number of new people added to the team on a higher grade than me. There is also a new management structure in the office which was not there when I started work, and I now have a new line manager.

I no longer get to do any of the transition work or travelling to customers sites as that now gets done by the people on the higher grade.

I feel that I have now been relegated to a lesser role.

 

Do I have any recourse in any way to rectify this.

The new line manager knows my feelings, but does not seem to care.

Are you missing on some things?... training?, bonuses?, advantages, which other colleagues would get and not you?...

Well, I would say that getting todo transition of services and first contact is an advantage I am not getting.

 

I would aslo say that a job has come up but because I did not get the training that others got in my team, I could apply for it, but would not meet the pre-requisites, so others have an advantage over me here also.

Were you entitled to get that training? Would have that training been part of a natural progression?

Your other colleagues have been to that training... you are on the same level as they are (?)... they get training and not you...

Well, I have got training but I have not got the training That they got for the new job that has magically appeared.

 

I have had training in other things that other peope in my grade have not had training for. The training I got was on the business critical training plan.

 

But it is more the first comment I made above that I am trying to determine if there's anything I can do.

Maybe you would be better to arrange a meeting with perhaps someone more senior than your line manager - if as you say they dont care - you could then ask senior management why you have been passed over, they have a duty to tell you why you've been passed over and what you can do to ensure that it doesn't happen to you again. You would then also be able to ask why they've come into a new job on a higher grade than you.

 

We have a similar problem where I work we are taking on a lot of new staff some of whom are coming into a job they have never done before but are now over people who have worked for the company for quite a while and it does cause a bit of friction. These new people also have never worked in this industry before and are now telling others how to do the job they've been doing for a long time.
