    • The last photo shows the overflow carpark looking at the block which our room was located. When we got out of the car my partner thought that the building was for staff accommodation.  The unsecured bedroom window opened onto this car park.
    • Also I see that you are doing a lot of this on the telephone – and without any written confirmation. This is a big mistake. You need to start taking this matter seriously and so everything should go in writing. If you have telephone calls then they should normally be recorded. Read our customer services guide. You should make notes about every telephone call and then you should send an email to your telephone correspondence confirming what they have said or what they have agreed. It is important that you keep detailed paper trails here. Of course we may be jumping the gun and maybe big motoring world will step up to the mark – but I'm afraid that they have a lousy reputation has you have seen and so you need to start practising survival techniques and protecting yourself. You say for instance in your letter of rejection that the mechanic told you on the telephone that the gearbox needed replacing. Do you have any other evidence of this conversation? This is going to sound a bit harsh – but other people will be visiting this thread as well for their own purposes. You conducted their research about this company before you bought the vehicle. You now are fully aware that this is a company which can be very difficult to deal with and causes a lot of problems for many of their customers and yet you are still taking a telephone/verbal approach. Do I need to say any more? Also one of the documents you put up is an email exchange but it is not clear who is writing to who or what dates. If you showed this email to somebody in a pub they would be asking lots of questions about who sent the first message, who sent the second message, what dates were they sent et cetera. Please think about this before you post things. Please can you clarify the details of that email exchange. Please will you present the information carefully. We are all volunteers here and we have to rely on you to do the spadework

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Everyone,

 

Sent my prelim yesterday to my mates at the Halifax.

 

By the way, has anyone gave the banks 7 days instead of the 14 in the Prelim and LBA?

 

It just seems to me that the banks will not pay up until court action is filed so does it really matter if we give them 7 days or 14?

We say 14 days so if it went to court the Judge would see that you were being reasonable

Called the halifax today to see if they had any intentions of refunding me - answer was, "we dont refund anybody"!

 

I hope someone reads this from the Halifax, cos I gave you the chance to refund me, now you will have to pay me my charges, interest and court fees. Then I will write to my local paper, and then help all in my community to reclaim their charges too!

 

I cant wait!!

Ladies & Gentlemen

 

I had a phone call from the Halifax today informing me that a full refund was on its way (including interest and court fees).

 

In view of todays press, I have contacted the Warrington Guardian. They are keen to speak to me with a view of including the article in next weeks paper. I will be recommending this site to everyone and offering to help anyone that wishes to recoup their bank charges.

 

I have currently won against the Halifax (£2200) and Birmingham Midshires (£770) but still await the cheques. I also had a letter from Nat West today offering me a full refund (£147) which I have accepted and will be credited to my account tomorrow.

There are a few hundred people at anyone time going through various stages of reclaiming their unlawful bank charges, we try and look at all the threads, unfortunately we cant see to everyone on a daily basis we all have our own lives to lead as well , and we do do this voluntarily, If you havent posted a question then we do not always reply, but I am glad you are procceding along with your claim and good luck to your awaiting your money.

This is a self-help forum and the idea is to empower people, not to spoon-feed them. Besides, I've just read through your thread and you haven't asked any questions for other users, Site Helpers, or Moderators to answer.

 

There are over 67,000 members so it is impossible to give one-to-one advice. I wish we could help people individually, but it just doesn't work like that.

That is your perogative. Donations are voluntary and the decision is left entirely up to you. However you seem to imply that you would have considered donating if you had received more help, but again looking at your thread I cannot see where you were looking for any help or advice.

Opinions given herein are made informally by myself as a lay-person in good faith based on personal experience. For legal advice you must always consult a registered and insured lawyer.

I am fairly sure that there are lots of people using this site in the way in which I have. I do not need spoon feed, I read, read and read again the FAQs before beginning my process and merely updated my progress out of courtesy - in the hope that I would have been congratulated and asked to donate.

 

I appreciate the huge numbers of people using this site who do need spoon feed and it is them that are taking up all of your time and effort because they fail to use the site as it is designed (self help).

 

My point is that you are loosing lots of potential donations because the site is lacking formal organisation.

 

I dont accept that your moderators are TOO busy to view all new posts, because they seem to have time to partake in offensive and time wasting threads that are of no use to anyone.

 

I will, however continue to recommend this site on a daily basis.
