    • there is NO exposure if you simple remove your name address/ref numbers etc from docs, over 10'000 pdf uploads are here. which then harvests IP addresses off of the people that then do so..which is why we do not allow hosting sites. read our rules and upload carefully thats exactly why we say capture as JPG, redact, then convert/merge to one mass PDF. then online sites to achieve that we list do not leave watermarks.  every once in a while we have a user like you that thinks they know better...we've been doing it since 2006 with not one security issue. thank you.

    • no they never allow the age related get out, erudio are masters at faking supposed 'arrears' fees which were levied before said date and thus null its write off. 1000's of threads here on them!! scammers untied that lot. i can almost guarantee they'll state it's not SB'd too re above, but just ignore them once sent. dx    
    • DX, worth mentioning? I take it that you refer to after ,65 loan is written off clause. I thought that after the problems I had at deferment (/no proof of income satisfied them, and I could not afford an accountant) after they stopped pestering that they had decided that the age related clause  had kicked in. As I said, its time to hit back with SB letter.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

This is my very first thread, so not too sure if I have got this in the correct place, please advise me accordingly. I am having a 'BATTLE' with Cabot, which I see from other post/threads seems very common. Anyway here goes, I wrote to Cabot on 3rd December 2009 a copy of this letter attached named: Cabot ARG Card Services Challenge.doc

 

I received a reply on dated 4th Dec 2009 saying they did not have the info but send a copy when retrieved, suspending the account in the mean time. I then received a reply dated 29th Dec 2009 stating that they had provided the info enclosing a copy of an Application for an Argos Card, and a separate leaflet with the terms and conditions. I replied to this with the letter attatched named: Cabot Argos Challenge Reply.doc

 

I today received a letter from Cabot the body of text attached named: I understand that you have received our response to your request under section 78 of the Consume.doc

 

The declaration referred to is attached as a transcript for information: Declaration.doc

 

Basically, have I come to the end of the road and lost the 'BATTLE'. Any help advise as to how to reply to the letter received today namely, I understand that you have received our response to your request under section 78 of the Consume.doc

Had basically exactly the same letter from them with regards to my thread:

I'm just writing to them stating that I disagree with their contentions and that we have set our final position clearly. I'm also stating that I feel a infinite game of letter tennis would be pointless and so I shall not respond to their letters etc unless they bring something new into the equation.

Hi Civic & welcome to GAG

 

From reading your post & contents within i cant see that they have provided you with a legal cca.

 

I would send them the " account in dispute " letter

[ see template section] stating that until you receive your original signed cca, legally they have 12+2 days to provide you with a legal cca from your original request, did you send your request by recorded delivery?, if they fail to comply the account is then in dispute until they can.

You don't have to deal with them until they produce your cca.

 

Someone with far more experience will be along to advise, in the mean time try not to worry & good luck

Have they ever actually sent you a copy of anything purporting to be a credit agreement?

 

If they have then could you scan it and post it up (removing all personal information) so that we can take a look at it?

Hi, thanks for your post. They sent an A5 4 page double sided leaflet. This was separate to a photocopy of the original Application for the Argos Card. I will try and scan and post it but it is very small text. Cheers Civic09.

No problem! It's just that if we can see it then people can assess whether it conforms to the relevant statutory standards or not. I suspect it may be very similar to my thread that I linked to earlier. So yes, if you can post it up and we'll see what's what.

Hi, I have scanned the 8 page leaflet with Abby Fine Reader and put the contents in a Word doc.

 

This was a separate leaflet to the application the declaration stated "I have read the T & Cs overleaf...see previous post.

OK well I don't personally think that is anywhere near enforceable.... but please wait for other more experienced members to come along and give their opinion.

 

I'm simply writing a letter as explained in my last thread.... I'll post up a rough copy shortly when I've finished. Alternatively there is a letter posted by another member in my thread.
