    • Thanks, I've had my fill of this lot. What makes me so mad is that I had to take out student loan to get any DHSS help. And then when I tried to help myself and family they presented obstacles. Might be worth passing story to RIP off Britain?
    • there is NO exposure if you simple remove your name address/ref numbers etc from docs, over 10'000 pdf uploads are here. which then harvests IP addresses off of the people that then do so..which is why we do not allow hosting sites. read our rules and upload carefully thats exactly why we say capture as JPG, redact, then convert/merge to one mass PDF. then online sites to achieve that we list do not leave watermarks.  every once in a while we have a user like you that thinks they know better...we've been doing it since 2006 with not one security issue. thank you.

    • no they never allow the age related get out, erudio are masters at faking supposed 'arrears' fees which were levied before said date and thus null its write off. 1000's of threads here on them!! scammers untied that lot. i can almost guarantee they'll state it's not SB'd too re above, but just ignore them once sent. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I've been reading about successes that caggers have had proving that agreements are unenforcable. Just recently, I have read several threads on another consumer forum that suggests that this is not the end of the matter.They claim that the CCC then sell the debt on to DCA, and the whole process starts again with letters and phone calls, if they don't have any luck , they sell it on -and so the process continues often beyond the 6 year period. So we can look forward to years of being hounded.These people seem to talk with great knowledge and authority.

I have several agreements which I am challenging, and I'm now wondering what the truth is. I did put a post of the consumer forum pointing out that there were a lot of successes documented on this site but they indicated that this was merely the calm before the storm and these caggers hadn't really 'won' as the debt would do the rounds.

I'm hoping that these posters are part of a conspiracy of misinformation formulated by cccs.

I'd love to hear from caggers who could prove them wrong!:oops:

I don't have personal experience of this but surely there is enough legislation to protect against harassment if that were to happen?

 

I do hope that someone with first hand experience can confirm this

Thanks sunshine, on my good days I think'If they can't do anything but bluster, bring it on!' on not so good days I think'oh no!'

There has been so many successes on this website that I am hoping that the debt remains on your file until it slides off in 6 years, but these DCA can be a bit of a pain in the whatzit even if you are aware of their limitations and your rights.

I'd just like some feed back from others who have been through the process.

This wouldn't be MSE by any chance? I started my journey of information gathering/empowerment there, sadly only recently, but have not been back since I discovered CAG (wish I'd found it 6 months ago!). My impression is the majority of folks on there think they occupy the moral high ground ("You spent the money so you have to pay it back"), and are unable to distinguish between a moral stance, and a legal one.

 

I have no personal experience of being chased by DCAs (yet) but am of the firm belief that there is enough factual info and encouragement to be found on CAG to deal with that, on strong and weak days, and for however long it takes to get rid of the lot of them.

The site is moneysupermarket and a lot of the posts are very informative and helpful, but just recently there have been a few that seem to be pushing towards getting a repayment plan organised otherwise you'll be chased by one DCA after another.If anyone wants to take a peek at posts by huckster(am I allowed to say that on here?)

It's good to know that someone is nearing the end of 6 years without experiencing a host of DCAs camped out on their doorstep.I'm beginning to think these guys might just be 'plants'.
