      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

a very quick and simple question I believe

 

At what point in proceedings must a lender stop adding interest to an account that has been defaulted then a Court Claim started?

 

I KNOW that this information is somewhere on this forum but just can't find it.

I believe it's when the agreement is terminated... then they no longer have the 'agreement' to say that they can add interest.. at least that's how I've understood it anyway.. :cool:

that's what I thought but I've got a terminated agreement where interest has been added for a further period (and added 3 months after court claim was issued) so I'd like to have a definite 'this is when they are no longer entitled to claim..'

I think for the definitive answer you would have to check your t&c's...:rolleyes:

 

As a rule it would be when the agreement is terminated, but it would be determined by the terms and conditions of your contract... if you have one that says they can continue to claim interest on a terminated agreement until settled then that's what it would have to be...

the terms and conditions state '..... Any such interest will be calculated on a daily basis from the date the amount falls due for payment until it is received and will accrue both before and after any court order payment.'

 

so does that mean, in theory, that they could continue to add interest until the whole balance of the account, including interest, is received or unless a court orders otherwise?

hi

it's a loan and according to their screen shots re my account they stopped accruing interest 9 months ago (a few weeks prior to issuing a court claim) and the interest rate on the account is 0 % from that date

 

I'm interested as I'm trying to make sense of the balance they are claiming and its not easy. They have provided a spreadsheet that shows interest accrued to a random date during the past few months and a PPI rebate upto another random date but neither date has any significance that I can see.

the annual statement arrived today and it clearly shows the start and end dates and the interest rate that applied during that period. It shows 0% interest and even explicitly states that the interest rate shown is what would be applied to the account for the dates.

 

What I don't understand is how they can issue a current statement showing 0% interest yet issue a claim which has additional interest accrued for some of the period which is supposed to be attracting interest at 0%.

it's Egg

 

there's interest at the rate shown on the agreement from a date in Sept 2008 to the remedy date on the DN (if that makes sense)

then there are two more dates that cover the rest of the year and they show interest at 0%.

then there is an amount of interest accrued during the year and I think that it's correct for the few months that the statement says interest was due.

 

hmmm difficult to explain without giving the exact details but hopefully this will be understandable
