You also have 5 minutes "consideration" time, so no overstay at all. You've already found out the hard way that these PPC's are the lowest of the low and just want your £££'s.   As long as you've only got demands and final demands so far you're ok. (You'll probably get a few more!) If / when you get a letter of claim is the time to take action. (Snotty letter if you've been reading up on here.) (The view is from 2022) Any chance of getting some up to date readable pics of their signage next time your friend is out and about?
    • yes schoolboy error - corrected to parking begging? im being polite,..following citizens advice.. when you have mental health issues and its causing more anxiety im asking the people demanding money to stop as it will only make the situation worse. the person in question is already in a lot of debt etc and cant pay it back and its not through irresponsibility that shes in debt
    • Advice noted! Seen you mentioned about a Paploc (forgive the spelling if wrong) You seem to know a fair bit about these matters, from reading your replies on previous threads. I just have another question please.    Am I right in assuming that the only way it can ever get to that is if the Italian justice system deems it worthy of assigning it over to the British justice system? As difficult as it may be.  I just want reassurances I guess. I can see the DCA giving up, but not the solicitor in Italy, I have no knowledge on these instances.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Dear Sir/Madam,

I am in receipt of your letter dated 07/12/06.

I respectfully decline your offer of half my claim that you calculate at £428.47, and request, once again, that you return to me all charges imposed on this account, totaling £875.93 + £80 Court costs.

 

I will accept the sum offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder, with my ongoing County Court claim.

 

 

I have once again enclosed my Schedule of charges for your information.

 

I trust this clarifies my position.

Hi,

 

I just sent the letter on its own. I didn't want to sign the letter they sent as I think I would have been just signing for the half offer.

 

I also Included another schedule of charges as the amount they stated was slightly wrong.

 

I sent them a copy by fax and post.

Thank you again, that's what I thought but thought it best to check! While your there do you know the fax number by chance or is it on their letters? At work now and don't have anyhing with me, I can't remember seeing a number anywhere.

I was just thinking if I accept their offer as part payment do I need to adjust my claim amount? Is this difficult to do? Has anybody done this? Please help me :?

Hi everyone,

quick update as I've not been here for a while:

I sent off the letter to say I will accept their offer as part payment but will proceed with my claim and as expected I've not heard anything back! Also my allocations questionnaire had to be submitted by the 28th December, so I submitted around the 21st and also sent a copy to the bank and I've not had one from them!! I don't think they've submitted theirs so I think I may have one!! Surely it can't be this simple? I guess I need to pop into my local court office on monday and find out what to do next. If anyone has known of this before, any advice would be appreciated.
