    • I have just read the smaller print on their signs. It says that you can pay at the end of your parking session. given that you have ten minutes grace period the 35 seconds could easily have been taken up with walking back to your car, switching on the engine and then driving out. Even in my younger days when I used to regularly exceed speed limits, I doubt I could have done that in 35 seconds even when I  had a TR5.

    • Thank you for posting up the results from the sar. The PCN is not compliant with the Protection of Freedoms Act 2012 Schedule 4. Under Section 9 [2][a] they are supposed to specify the parking time. the photographs show your car in motion both entering and leaving the car park thus not parking. If you have to do a Witness Statement later should they finally take you to Court you will have to continue to state that even though you stayed there for several hours in a small car park and the difference between the ANPR times and the actual parking period may only be a matter of a few minutes  nevertheless the CEL have failed to comply with the Act by failing to specify the parking period. However it looks as if your appeal revealed you were the driver the deficient PCN will not help you as the driver. I suspect that it may have been an appeal from the pub that meant that CEL offered you partly a way out  by allowing you to claim you had made an error in registering your vehicle reg. number . This enabled them to reduce the charge to £20 despite them acknowledging that you hadn't registered at all. We have not seen the signs in the car park yet so we do not what is said on them and all the signs say the same thing. It would be unusual for a pub to have  a Permit Holders Only sign which may discourage casual motorists from stopping there. But if that is the sign then as it prohibits any one who doesn't have a permit, then it cannot form a contract with motorists though it may depend on how the signs are worded.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

On 17th March 2009 the Ministry of Justice announced plans for a new code regulating the activities of bailiffs and one of the changes was to introduce a much needed certificated bailiff register allowing debtors to check on-line whether a bailiff is certificated.

 

This is now available from the following link: www.hmcourts-service.gov.uk/CertificatedBailiffs/

 

 

As you will see, you may search by either providing the bailiffs first name, surname or employers name. However....could you please note that if you are searching under the name of the company ...for some companies you will need to provide the full name of the company as following:

Could you please note that a bailiff’s certificate is valid for just 2 years.

 

If your search reveals that the bailiff is working for a different company it is important to be aware that statutory regulations laid down by Parliament state that if there are "any changes" to the certificate then the bailiff must “without delay” give notice to the Court and a new certificate will be issued to him reflecting the changes. This is vitally important because in almost all cases, the bailiff’s bond will be cancelled when he leaves his previous employer!!

 

As I have said many times here on the forums, it is always the case that if you have a complaint about a certificated bailiff then this should first be sent to the bailiff company to address and a Form 4 Complaint to the County Court should wait until the company have had an opportunity to sort out the complaint.

 

As a Form 4 Complaint can have serious repercusssions for the individual bailiff, the County Courts also expect that the debtor should at least allow the company to have the opportunity to sort out the complaint. By doing this you will avoid being criticised by the Court.

 

There is a seperate thread in the STICKY section here entitled: "How to Complain to the Court about a Certificiated Bailiff" which should be read first if you are considering a Complaint.

 

PS: As the bailiff is working as an "agent" for the local authority, a copy of your complaint should be sent to the council as well and you need to ensure that you request that it is recorded as a formal complaint.

I have checked the name of a bailiff that has been on 3 occasions to me from Marstonsand his name is not on the list or on the Marstons list. Can I get the money back? Or what other action can I take.

It depends on what debt he was enforcing. If it was an outstanding MAGISTRATES COURT FINE (ie driving without insurance, no tax, or TV licence etc) then HMCS allow the bailiff to work UNCERTIFICATED for 6 months !!

 

Madness I kinow...but I don't make the rules !!!

A good point and one that is asked often.

 

There are even rumours that bailiffs enforcing these unpaid Magistrate Court Fines start working for the company and after 6 months leave and are then re-employed !!!

 

I would suggest writing to the company to say that you are aware theat the bailiff is working as uncertificated and could they please confirm when the bailiff was employed by them. A copy should also be sent to the court.

I can't find Rossendales bailifs at all on this list. If you search for Rossendales as an employer nothing comes up?

 

Does anyone know if this is the case or if they are listed as something else?

 

There will always be "teething problems" with things like this and I do know that the Ministry of Justice are addressing these problems so as to ensure that searches are made easy.

 

A search can be made of the EMPLOYER..ie: Rossendales BUT you need to make sure that in the SEARCH BOX you put the FULL NAME of the Company.

 

For instance:

 

 

For Rossendales you will need to put: Rossendales Ltd

 

For JBW you will need to put: JBW Enforcement Ltd

Thank you Tomtubby. With your help I found the company , but the bailiff who visited me is not on their list. Is this significant or just a normal occurence?

 

The bailiff MUST be certifictaed when enforcing a dent for outstanding council tax or an unpaid PCN.

 

From memory, this company used to have a section on their website where they listed the names ( and photo's) of all bailiff that were certificated by them. It is worth checking whether this is still on their website. But in answer to your question...YES... the bailiff must by law be certificated.

 

If and I'm certificated bailiff levies upon goods or charges you will see then the levy would be invalid and the fees must be refunded.

 

In the case of enforcement of a debt for an unpaid parking ticket, the Road Traffic Act specifically states that only certificated bailiffs can enforce these type of debts and that if the bailiff is not certificated then he is committing an act of trespass and that action can be taken against the "bailiff" and who ever has instructed him (this is normally the local authority!!).

Does anyone know of "High Court Enforcement Ltd"? I've looked them up on the link and there's nothing. I've looked up their "representative" and there's nothing.

 

In the paperwork it says he is a "High Court Enforcement Officer" - what is that?

High Court Enforcement Officers are NOT on the list.

 

This is because the list is ONLY for CERTIFICATED BAILIFFS enforcing unpaid council tax, parking charge notices, child support agency arrears and unpaid rent.

I have just discovered that the bailiff chasing me for council tax is not on the list. I searched by both the company and his name. What does this mean in terms of my debt? I haven't paid him anything but he keeps coming round and scaring my children!

 

I would suggest sending the bailiff a text message to say the following:

 

I have searched the Ministry of Justice website and this does not show you a being certificated. Can you confirm to me what date you were granted a certificate and at which court?

ooooh ooooh this is interesting! i have just searched the names of two bailiffs who have been round to my house to collect PCN's on behalf of a local authority and guess what................yep you guessed it, neither are on the list.

 

So how does this work to my advantage, who do I report this to and does this mean that these people can't chase me any more?

 

If a bailiff enforcing an unpaid PCN is not certificated then according to section 78(7) of the Road Traffic Act he will be committing an "act of trespass" !!

 

HOWEVER..an error MAY have occured and therefore I would suggest sending the bailiff a text message to say the following:

 

I have searched the Ministry of Justice website and this does not show you a being certificated. Can you confirm to me what date you were granted a certificate and at which court?

hi guys could some one please help me had a nasty run in with hammond hillman limited bailiff today,im still sitting her in tears.

 

tried to check if he is on the list but neither him or his company is comming up,what am i doing wrong?

 

I have checked the list myself and have found that they have 10 bailiff's listed as being certificated.

 

In the search box you need to put the following:

This is a big database to put together and for it to be totally accurate requires input from each and every "issuing court" in the Country and Bailiff companies and individual Bailiffs as well.

 

If a bailiff is not showing as certificated then the follwoing text message can be sent to him or her:

 

 

I have searched the Ministry of Justice website and this does not show you a being certificated. Can you confirm to me what date you were granted a certificate and at which court?

 

Any bailiff who is in receipt of a valid bailiff's certificate should have no difficulty at all in responding to this text message within a very quick period of time.

Which statutory regulations stipulate that the bailiff must give notice to the court of any changes in his circumstances?

 

 

 

The authority is contained in the Distress for Rent (Amendemnt) Rules 1999 where in Clause 12 it states the following:

 

12. After rule 7 there shall be inserted:

 

 

  • " Change of bailiff's name, address, etc


  • (1) In this rule "relevant details" means a bailiff's name, address or other written information appearing on the certificate.
     
    (2) If there is any change in the relevant details, the bailiff shall without delay give written notice of the change to the issuing county court and produce his certificate ("the old certificate") to the court officer of the issuing county court.
     
    (3) When a bailiff gives notice and produces the old certificate in accordance with paragraph (2) above, the Judge of the issuing county court shall issue to the bailiff a replacement certificate reflecting the change in the relevant details but in all other respects (including, without limitation, the date of expiry of the certificate) the same as the old certificate.
     
    (4) When a replacement certificate is issued in accordance with paragraph (3) above, the court officer shall retain and cancel the old certificate.
     
    (5) No fee shall be payable for the issue of a replacement certificate in accordance with this rule.".

yeah that is the levy alright. it is not really valid as sig is just scribbled on. I suggest ytou ring the bailiff company just to make sure they have got the message about not chasing you. they will keep coming unless the council call them off.

 

IF IT WAS ME, I WOULD MAKE SURE THEY HAVE BEEN CALLED OFF AND NOT TAKE THE COUNCILS WORD FOR IT. THEY MAY STILL TAKE YOUR CAR IF THEY THINK THEY CAN.
