    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all

Im just starting a hardship claim and have a few questions:

I have received my customer financial statement from natwest which i have completed and am about to send back with evidence to support it.

I put my two claims into court, they were then stayed.

I applied the rate of 29.69% to the one claim which totalled over 5000 so I split it into two. Should I only apply a rate of 8% to this hardship case? or continue to ask for the two claims so it matches the ones in court?

any help greatly appreciated.

I have decided to go with the 8% then if anything comes of the test case they might consider the differendce with the claims in court?

Do you have priority debt arrears(mortgage/rent, council tax, utilities)? Are any of the priority debt arrears being paid off by arrangement?

Are you aware with hardship claims you can go back to July 2001?

I have arrears with all of the above and evidence to prove this, they are not being paid off by arrangement at present, although I will have to make one soon!!

my claims go back to 2001.

Sounds to me like a fairly good case to be honest as it stands.

Is the account still being used?

no, I stopped using it about 3 years ago, I have about 3000 in charges with 8% interest included, it is in court in two claims though? with 28% interest, not sure how it will affect this? I am also on a dmp

In that case scrap what I said. As you stopped using the account banks do not have to refund as the hardship may not have been caused directly by the charges(but you might get an offer imho). Have you reclaimed on any other accounts as a result of financial hardship?

ah right, no I havent, I stopped using the account as the charges they were applying were too costly, got another basic account which is frequently overdrawn though and the hardship began with those charges? maybe they will make me an offer?

If the hardship began with the charges on the basic account then get the claim in NOW under financial hardship cos you looked good(so to speak) for hardship based on arrears.

  • 2 weeks later...

Hi

I need some help please!!! I have received a reply from natwest (within a week?!) which says that my hardship claim has been accepted and that they will be in touch with an offer towards the end of this week.

I havent used the account I had with them for at least three years now, the letter said the money would be paid into my account which will probably be milllions of pounds overdrawn by now, if its still active, which they seem to think it is.

has anyone ever heard of them paying by cheque or into another account?

any reply greatly appreciated

ok so I spoke to a woman today who said that they have offered me 1866 (I am claiming 3000) but this will be paid into my old account which is now inactive. I have debt with natwest which i am paying through my debt management plan, they said they will release 850 of this in cash for my priority debts and the rest will go towards my debt.

i thought the account was closed, turns out it wasnt and that they added £1000 of charges to it when i stopped using it, they want the other money from the offer towards this.

any suggestions?? should i reject the offer (its about 65%) or take this cash and run? I have claims in court as well which there has been no mention of.

im also annoyed about the £1000 of charges they added, but I have no statements etc to try and claim these too, should I put in a letter requesting that these be wiped?

any help as always appreciated :)

Why are you wanting to reject the offer?

Will it clear any priority debt arrears?

And SAR for the details pf the £1000.00 ;)

No worries, remember that no offer is a full and final settlement of your whole claim because they cannot do that. This represents the financial hardship part of it only.
