I have just received a CCJ re an overdraft with NatWest. The background is that I had my own business which all went a bit wrong. I am a qualified management accountant (the business was unrelated to this) and I am desparately trying to get back into employment as a management accountant again which would allow me to earn enough money to be able to deal with my debts. I explained to NatWest that if they went down the CCJ route it would severely impact my ability to get back into this higher paid employment and would make it virtually impossible to be able to pay any of my debts off going forward. Other parts of the RBS Group as well as my other creditors have accepted this arguement and are allowing me to pay token payments without reverting to the court system for the moment. Due to NatWests action these agreements are now effectively meaningless as my job search is probably now going to end. I know this is a very, very long shot but I was wondering if I had a case for suing NatWest for loss of future earnings as a result of there actions ?

Difficult one.


I would, as a first step, stop paying all the other creditors - or at least those from other parts of the RBS group. You should explain fully why you have done so.


As to obtaining compensation from Natwest I would suspect your chances are extremely slim. As is their chance of being repaid now.
