    • I did call the police both in the UK and in my country but both of them said no way to get the money back now. I tried my best not panic but it indeed influenced my life in many ways, the only thing I could do is start therapies. It happened around February- March, so I started to do this shoplifting thing to cover my rent and everything from the end of March, it’s been a month now… today it my first time to get caught. I know it’s very very bad, I seriously didn’t want to do this at all. But luckily I just saw an message from HR, they asked me to have an online interview next week. I’ll stop this behaviour and wish my messed up life back to normal soon 
    • did you contact your bank about the fraud? contact the police , action fraud anyone in authority? have you done anything about it? when did it happen? dx

    • Thank you, I was been told that it’s a serious crime if I shoplifted above £200, (this time £500, I gave the thing back+ last time probably also around £500 which I didn’t give back).. and I admitted to them that I sold those things at very low price to pay for food and stuff.   That’s why I was worried..as it wasn’t my first time.. I also did it in John Lewis in the city I live, but when they asked me I said I didn’t steal things from it as I don’t wanna get caught in my city. But I don’t know when they upload my pics in the system will they recognise me and think of me a professional shoplifter than against me… so what happened about the fraud was that what there was a phone call told me that my visa has problems etc due to I helped bad people do money laundering etc. I said I didn’t then they tried to ‘control’ me and many things happened to make me believe what they said… as soon as I gave them the bank details I lost all the money in it.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

On Thursday 09 April 09, I had a bank current account available balance of x pounds, but my online bank account showed a zero balance.

 

On Friday 10 April 09, I tried to make an online transaction but my card was declined.

 

On the same day, I sent a secure online message to my bank informing them of the problem I had with the online transaction and they replied informing me that I had an available balance of x pounds and my debit card was still active.

 

Yesterday the 11 April 09, I tried to make an ATM withdrawal but again, my card was declined.

 

Today, I have again sent a secure online message to my bank explaing that I am not happy and am awaiting a reply.

 

Obviously, I am unable to withdraw money from my account or make any online transactions.

 

For your information, my online bank account still shows a zero balance and there is nothing wrong with my debit card.

 

Obviously this is a bank problem and over the Easter period I have been unable to access my money.

 

Due to the bank's error and I able to claim compensation or will I just get an apology on Tuesday.

 

Comments would be appreciated.

If the account is at £0 is there an overdraft on the account? Are you drawing funds from a cheque you paid in earlier in the week? Still not clear at the moment why you can't use your card.

I have no overdraft on the account and I have not paid any cheques into my account.

 

I honestly believe something has gone drastically wrong at their end.

 

Showing on my online account is a deposit balance of x pounds and an available balance of zero pounds.

 

I am still awaiting to hear from the bank and now it probably wont be until the next business day on Tuesday.

Have you got internet access? Is there any pending payments? Have you telephoned them? Is it a recurring payment?

I have just received a secure message from them in which they informed me that my account and card are both active and they see no reason why I cannot withdraw money from an ATM.

 

They informed me to try another visa ATM. I will try tomorrow.

 

In the meanwhile, I tried to make an online purchase transaction but the company said there was a problem in validating the card.

 

Yes I have internet access to my account. There are no pending payments. I have telephoned their call centre but get the same response. It is not a recurring payment - and so it goes on.

Would you have any payments normally due to leave your account on monday? sometimes backs earmark money so that may be why your available balance is zero.

 

These payments will then show up on your statement as leaving on tuesday.

No payments are scheduled to leave my account Monday or Tuesday.

 

I honestly believe that this is a bank system error thus preventing me from obtaining any money from my account over the Easter break causing me hardship and distress. I'm sure all will be revealed on Tuesday (business day).

 

IF this is the case, no doubt I will get an apology from the bank but can I take further steps in this matter and lodge an official complaint (have all the evidence), with the bank or take this matter further by contacting say the financial omundman or whoever?

 

Today Monday, I am again going to try and withdraw money from an ATM.

Still no joy. Tried to withdraw money from an ATM but the card was declined - and so it goes on.

Tomorrow (business day) it will be all back to normal I'm sure.

Have you checked with your bank whether there is any issues with regards to the actual card itself?

Does the internet banking say available funds is £0?

And does the account have a balance not available to you?

I am still no better in understanding what is causing the problem.

I am still no better in understanding what is causing the problem.

 

There is definitely no issues with the debit card.

Internet banking is zero pounds AVAILABLE.

Internet banking is so much pounds ON DEPOSIT.

 

There is no question that I have more than sufficient available (CLEARED) funds in my account.

 

Yes, something I cannot understand also. All will be revealed tomorrow, I'm sure.

You will need to go into a branch of your bank because your card will still not work tomorrow(cos of the bank holiday, not much will change from today). Please post up what information you do get cos I am puzzled in all honesty as to the reason why you cannot draw on the funds.
