    • No i decided I would try and keep paying this down as best I possibly could and have paid over 35k off of the total amount. It’s been hard as hell tbh but just seems too much to do with the prospect of job disruption looking. the issue I have with pro rats is the credit file is trashed anyhow like you are defaulted anyhow is it not? I am willing to trash it for 6 years if needs must but having it trashed for over a decade seems crazy. This is the dilemma I am in

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I am in the middle of a heated debate with the Coop about fraudulent use of Chip and Pin cards and their responses are quite frankly amusing. A friend of mine had £200 taken out of his account via an ATM, 23 minutes after he had made a withdrawal. The bank had said that they know it is him who has taken it as the machine verified his PIN. He denied this and said that no one had his card, details or permission. The banks response? 'we know you took the money out and you will be held laible' Even after telling them that this contravened the Banking Code, ie the bank MUST prove that the customer was aware of the transaction or made the PIN known to another person' they still said that this did not apply to the Chip and PIN cards. This goes against the advice given by

Sandra Quinn of APACS who said

 

'the banking code had not changed and that before they could reject a claim for fraud, banks were still responsible for proving that a customer had authorised a transaction or had made their PIN known to someone else.'

The Bank can provide no evidence to support their stance and state that Chip and PIN is infallable.. yeah what a laugh, see the recent Shell fiasco. Any suggestions?

I think that is a load of rubbish. My understanding with CHIP and PIN is that while the card itself can still be cloned the CHIP itself is not as clonable. To explain this I cannot give you exact details because of obvious reasons. However, the banks systems do recognise a Chip and a questionable chip used in a machine. I am surprised that a card would have been cloned just 23 minutes after the card being used in the machine but the bank maybe aware either a device at its cashpoint, i.e. a number of people reporting smilar instances at or aroung the same time.

The bank have to investigate the claim and you should report it to the police who will supply a crime ref number. If the card remained in your possession(of your friends possession), the first step is to cancel the card and reissue a new card forsecurity reasons. The second is to give dates, locations and times of transactions which would be needed for reporting to the police. The fraud form would be completed with Crime Ref Number or as much info as to where it was reported to, etc, etc, then the card would be taken of cust and sent to fraud team to investigate. As I stated above there is a way to identify if it is the real card or a cloned one.

I'll leave that with you for now. This is the process at NW, but i would expect other banks to have similar things in place.

As far as Im aware, to withdraw from an ATM, you do not need to have a pin. The metalic stripe is all that is needed

True but most cards are chip and pin and the atm can recognise the difference between a chip and pin card and a "scrambled" chip

I have read several notices, some by the high street banks, which show that even if you remove the chip from a chip and pin card they ATM will still give you money. Even when confronted with this info the bank deny there is a problem..ostrich mentality or what?

simnonmci-If the chip is removed, you are right that the card can be used in an atm but the bank WOULD be able to tell if the card was one where the chip had been removed or a dodgy card

I lost £400 from a cloned card in an ATM. For a change the Co-op were very helpful and I got a my money back from them in about 2 weeks. Not much help I admit but they are paying out when they believe the claim.
