    • The last photo shows the overflow carpark looking at the block which our room was located. When we got out of the car my partner thought that the building was for staff accommodation.  The unsecured bedroom window opened onto this car park.
    • Also I see that you are doing a lot of this on the telephone – and without any written confirmation. This is a big mistake. You need to start taking this matter seriously and so everything should go in writing. If you have telephone calls then they should normally be recorded. Read our customer services guide. You should make notes about every telephone call and then you should send an email to your telephone correspondence confirming what they have said or what they have agreed. It is important that you keep detailed paper trails here. Of course we may be jumping the gun and maybe big motoring world will step up to the mark – but I'm afraid that they have a lousy reputation has you have seen and so you need to start practising survival techniques and protecting yourself. You say for instance in your letter of rejection that the mechanic told you on the telephone that the gearbox needed replacing. Do you have any other evidence of this conversation? This is going to sound a bit harsh – but other people will be visiting this thread as well for their own purposes. You conducted their research about this company before you bought the vehicle. You now are fully aware that this is a company which can be very difficult to deal with and causes a lot of problems for many of their customers and yet you are still taking a telephone/verbal approach. Do I need to say any more? Also one of the documents you put up is an email exchange but it is not clear who is writing to who or what dates. If you showed this email to somebody in a pub they would be asking lots of questions about who sent the first message, who sent the second message, what dates were they sent et cetera. Please think about this before you post things. Please can you clarify the details of that email exchange. Please will you present the information carefully. We are all volunteers here and we have to rely on you to do the spadework
    • I told the DM that the room was not acceptable because of the reasons already mentioned. He informed me that they were full that night and that they could move me to the room next door (would not solve my problem with the rooms location). Told the DM that I could not stay in the room provided for the night so left no option but to leave. DM did not reply and I walked out.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi people

 

I sent off CCA requests to all off my creditors in October 2008. I have had none off them bar Egg send a true copy of the original agreement. Anyway i have checked both my credit reports with equifax, and experian. Low and behold Lloyds Loan is showing that it was settled in 2007! In my letters to them i asked for all relevant data to be removed from the credit ref agencies, so that date sort of makes sense.

 

YES!!! I think it has worked? Am i now £8,500 less in debt!!!???

 

It is showing as settled on both credit reports! Has anyone else had this happen to them?

 

Thanks to all the help of the people on here!!! Am going to keep writing to all the other creditors, and hopefully i will have the same result...

thanks for the quick reply. I am totally over the moon with this. How do i get it removed though? If it is showing as settled on mt credit file, does that mean that they cannot hound me for it in the future if they find the original agreement. not that i think i signed one in the 1st place anyway. It doesn't say that the account has defaulted, but there are 3 missed payments on there.

You should be totally over the moon with this.. you have done well - no they can't hound you for it in future :D

 

If it doesn't say Defaulted.. don't worry about it!!! You have got away with it... :D:D:D

 

Even better.. 3 late payments means nothing.. in 6 months they will have gone!

"settled accounts are kept on file for six years from the settlement date. The status history in respect of a settled account relates to the period of time prior to the date of settlement"

 

any insight into this?

 

I honestly couldn't believe it when i read the credit file. I had to read it back about 10 times before it sunk in!

Yes but a settled account doesn't have a default - a defaulted account showing as settled is detrimental.

 

Yours was just a settled account after a few missed payments.. honestly.. you have nothing to worry about!!

 

I am trying this now with Next and Capital One and Natwest (one is a settled Default but I want it removing).

 

I hope I have the same success as you :)

no, far from it at the mo.. And by the way, i think i have got away with a inteligent finacne overdraft (about £220) as its not showing on either credit file. Whoop Whoop!!!

 

I have still got about 15k in credit cards to sort out. looks like i will have to pay for the egg card as they sent the original copy signed etc. but all of the rest have not so far produced the true signed agreement, so i sent off a few more letters yesterday, and am not paying them a penny at mo untill they produce one.

 

A few of them have sent me copies of the terms and conditions etc. Halifax even sent me all the statements from the date the account was opened (and i didn't have to pay anything for it), but not the true signed copy of the agreement. So i guess now its just a waiting game.........

Are you sure your Egg card agreement is enforceable.. I have just been reading another Egg CCA thread! Have you posted it up?

 

Stick at it, it's a long boring process but as you have found out.. well worth it :)
