    • Thanks, I've had my fill of this lot. What makes me so mad is that I had to take out student loan to get any DHSS help. And then when I tried to help myself and family they presented obstacles. Might be worth passing story to RIP off Britain?
    • there is NO exposure if you simple remove your name address/ref numbers etc from docs, over 10'000 pdf uploads are here. which then harvests IP addresses off of the people that then do so..which is why we do not allow hosting sites. read our rules and upload carefully thats exactly why we say capture as JPG, redact, then convert/merge to one mass PDF. then online sites to achieve that we list do not leave watermarks.  every once in a while we have a user like you that thinks they know better...we've been doing it since 2006 with not one security issue. thank you.

    • no they never allow the age related get out, erudio are masters at faking supposed 'arrears' fees which were levied before said date and thus null its write off. 1000's of threads here on them!! scammers untied that lot. i can almost guarantee they'll state it's not SB'd too re above, but just ignore them once sent. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I applied on line for free broadband with Tiscali, which also meant moving the land line from BT to them, this was back in August last year. when the confirmation came through the post it said they would charge for the broadband, I rang their call centre who said free broadband wasn't available in my area, (even though on line it said it was), so I cancelled my order, and confirmed with BT that I am staying with them.

And now I am receiving phone calls from tiscali saying i have not paid my account, again I rang their call centre, who now say that I only cancelled the broadband and that my land line is with them. They haven't sent me any bills, and the original account details that they sent by email don't work anymore, it says I dont have an account with them. i have emailed and faxed letters across, but no response yet.

As anyone else had this happen to them?

And advice please. I am worried my land line will be cut off, and i will then end up paying BT to put me back on again.

I thought we had been, but on checking it this morning they had stopped collecting the direct debits at the end of September last year. So I know we owe someone. I just thought it was still BT, and not actually having received any Invoices from Tiscali, i dont know what they are charging us, and i had only wanted to move to them with the offer of Free Broadband.

How did you do that? Did you get a final bill from BT, you should have done if you 'left' them.

I would contact BT and ask what's going on at their end, they might be pleased that you still want to be their customer. I wouldn't recommend Tiscali, not that I'm a fan of BT either.

Why aren't we revolting?

I rang BT, who confirmed in writing that I was staying with them, and they actually said that Tiscali hadn't put in the order to change over to them. I then got a final bill from BT, I emailed them to tell them they were wrong and that I was staying with them, so they then just cancelled the Invoice. And i thought that was the end of it all.

Update - Tiscali said - whoops, sorry our error, will credit you. and now I have no phone line, BT say it wasn't their problem and they are not to blame, and do I want to open up an account with them! Have sent them both emails asking them to sort it out. I expect this is going to cost to be put back on.

I looked at various other providers, but they all say that I have to have BT put my land line back on? Any ideas, is there anyone else I can go to without having to pay BT to put me back on.

If you want the phone back quickly, I would pay BT to put it back on (say in writing why you are doing it) and slug it out with them later for the money back, plus compensation :D. If you have the written confirmation from them they can hardly argue.

Thanks for the advice.

 

BT have now put me back on, without charging me. But now Tiscali, after confirming in an email that they would credit the outstanding account as it was their error etc., have now come back to me asking for the payment, saying that they couldnt credit it after all.

 

Any idea where I stand with that, Can they say in writing that they will credit it and then come back later chasing it?

 

I cancelled the order well within the time limit, it was their error, so I don't have a contract with them?

All contracts have a cooling off period, you clearly cancelled it within this time and BT's letter confirms this. So tell Tiscali to go scratch as well. They'll pass it to your friendly debt collector who will soon shut up when you say you got things in black & white so they more than welcome to argue. Get everything in writing, even email, avoid talking to them on the phone.

God no! Sit tight and let them do their worst. In the meantime, send them an email or a letter requesting that they look at it again with a copy of the 'apology'. And ask for compensation. Expect it to take a very long time.

I'd agree. Make sure you keep a record of any letters they send and if they start phoning you keep some sort of record (times, dates, etc)

 

You should be fine, but it won't hurt to be prepared :wink:
