    • This is essentially a shared area where there is some private parking but there is also customer parking for a shop that is labelled as customer parking with a time limit of 30 mins.  A friend of mine also received a similar notice around the same time so I assume they are just trying it.  The photo evidence doesn't really show anything as it is pitch black and shows an entry and exit less than the 30 minutes allowed in the customer parking spaces.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well, the reply to my letter post 101.. i'm getting closer.. but, no cigar just yet. I'll give them a week or so to send me the settlement confirmation details (they really don't want to do that do they lol) but if i get nothing further i have a mind to go straight to a Solicitor.

Sometimes it's easy to think 'am i being too difficult, enough is enough' or even 'am i being unreasonable'. But then you read stories like this and instantly you know.. there is nothing too unreasonable when it comes to making Creditors tasks more burdensome.

 

Nobody at Capital One is going to harm themselves over my letters. They are going to file it and go home at the end of the day (job well done) with a smile on their face after bombarding people for 9 hrs.

 

It's upon remembering this that you know you are in the right.

If they have amended the Credit files correctly that's even more proof an agreement was reached so as far as i am concerned getting the settlement info in writing is just a formality.

 

I'll leave it a week then order CRA files from all 3 and will write to Crapital1 thereafter :)

Yeah, would have liked the discharged account number on there but i think it will do.. along with the CRA files and this letter anyone who tries it on is going to find it very difficult to show i owe Cap1 anything.

 

Time to forget about Cap1 as i really don't think they are bright enough to understand what it is i have been asking for lol

Hi Jezzy.

 

Sorry to hear about your illness. I know it seems like it's all happening at once but I've seen people get out of worse pickles.

 

A lot of the issues you have raised i am not that familiar with personally so would be my opinion only and you need concrete facts and help, but for a start i would ask the obvious:

 

Have you contacted National Debtline or the CAB for help and advice.

 

Have you requested the Credit/Loan agreement under the CCA1974 for any of your accounts?

 

Seems like you have some charges making up some of the debt there. If they are non-bank overdraft charges then you can reclaim those. Have you looked at that aspect to reduce the debt?

 

Can you (have you) been to your Dr for a letter stating that these issues/worries and contributing to your health problems. If your Dr is sympathetic and you can get that it won't make creditors treat you respectfully in an instant but it may prove useful.

 

If either of you are in receipt of the following you may be entitled to Legal Aid and could get a Solicitor fighting your cause for you:

 

  • Income Support
  • Income Based Job Seeker's Allowance
  • Income-based Employment and Support Allowance
  • Guarantee Credit

I would first off, start new threads in the Legal Issues forum (by clicking "new thread" button top left of the page )for the Hitachi and GE Money/Link issues:
