    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Spam Your Enemies... the fun way!

I spent an entire saturday afternoon doing that. I even set up a free email address so I could see how much spam they would get. It's been two weeks now and the free email address I have hasn't had one spam email yet.

We need to complain lol

I get about 200 a day - 40 of those offering anatomy extensions. If I'd taken them all up I would have been able to douse the Weston-Super-Mud pavilion fire single-handedly even from where I live.

Fred

I thought of having one of those. But then it would drag on the floor. So best not to really. ;)

In your case FB it wouldn't be much use as gingerbread goes 'limp' when it gets dipped in anything wet:lol:

Unless it's a Hobnob. The marines of the biscuit world.

Dip me again. I can take it. :D

I hope by fb you mean fuzzybobble and not Fred Bassett, I won't have those sort of aspersions cast in my direction. How to make it 10" long? - simple, fold it in half.

Regards.

Fred

If I had one 10cm long I'd be keeping quiet about it, never mind posting on a public forum and wanting to fold it in half. :D;-);-)

More aspersions. From memory, an inch is equal to 2.54 centimetres.

A mate of mine was having a go on an internet datingsite last weekend. One of the girls profiles he looked at was deffo a DCA employee,as two of the comments she made were "Must have a secure job." and "must not have any debt problems."

I'm soooo tempted to get on there myself and if I got a date, take along my collection of DCA letters and my replies.

Show them to her, and say "See, I have no debt problems" :D

She'll hate me I know she will. All the nice girls hate me.

That's why I don't go looking for nice girls anymore, ;)

That reminds me of the old saying: "drink problem, me? - definitely not, I drink, I get drunk, I fall down. No problem."

Regards.

Fred

Yep, if you have no funny stories about when you last got drunk, then you got drunk alone and that's when you got a drink problem

If you can get ratted for less than a fiver, then life is great. Even if you have to admit that you're a lighweight. :D

I am a bit worried now :(

In a total act of stupity and anger I entered my errant husbands e-mail address on this site

He has left me in a load of debt and has previously physically and mentally abused me..... So I thought it might be a good revenge

But upon reflection I am now scared

What if he finds out the e-mail came from my IP address (which is traceable)

I have never done anything as stupid as this before

Do you think if he gets horrible spam he will find out I did it???

Gosh I am so scared :(:(

I tried the spam site on a disposable email address. Also added every DCA's email address I could find in 3 hours on Google.

It's been 2 weeks now and the disposable email address I added hasn't had a single spam email yet.

Just as well I've become a Facebook addict. It's amazing how many friends from the past have popped up on there. And a load of peeps I don't remember, but have added me anyway.
