    • Thank you. We like to see also the exchange between you and the mechanic/garage telling about the gearbox. Also, send an email to the garage whose mechanic called you:   Get this email to them as soon as possible. Hopefully it will draw a response which will confirm what they say – but even if it doesn't draw response – as long as there is no denial then it is fine. Even if there is a denial, it won't be too important but it would certainly be nice to get a paper trail which supports what you say. Please send this off and come back here and confirm that you've done it

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Had bailiff out in december for council tax and signed walking possesion order, didn,t realise at the time what it was as he said it was payment plan and I was under duress while he was there,I was seriously ill and unable to work for 7 weeks so missed a payment, informed them of this and restarted payments again last week ( I pay online to them). They emailed me back saying my payments would have to increase to cover what i had missed, which i was willing to do. Less than 10 minutes later they recalled the email and sent another telling me to contact bailiff. I rang him and he said needed the whole amount or he would take goods. He came later that day and put a letter through the door charging me another £110 for this and telling me to ring him again. I only got the letter late friday when i returned, and am now so scared of ringing tomorrow, he has point blank refused any sort of payment but the whole amount. I am terrified he will come back tomorrow as I am a registered childminder and will have children in my care alll day and cannot deal with this. Is there anyone who can advise, council don't want to know.

Also watch the charges they add on, Rossendales added additional charges onto my council tax debt, I complained, they backed off and the council took it back in house. I have made a formal complaint against Rossendales which is currently under investigation.

Can you let me know the name of the bailiff and I check to see if he is certificated . Can you make sure that you send this info by private message ONLY.

 

What items have been put on the walking possession?

 

You need to be aware that bailiffs can assume that you own the goods. If is for you....not the bailiff to prove that the items are exempt. Did you tell the bailiff that goods are on HP?

I'm at Stage 3 with the council whereby they have an independant investigator now looking into this.

 

I have advised them, should they not conduct a fair investigation, i shall put this matter before a distruct judge to look into. They are at the moment playing ball it would seem.

 

But Stage 1 and 2 of the Councils complaints system have failed.

didn't tell him they were on hp as didn,t know he was listing goods, had 3 children under 3 in my care at the time and was distracted by them. Trying to look after kids and have conversation with someone, impossible, he just said what i should pay, i agreed, he said sign this, i did (stupidly without reading it) then he left saying i can see you have your hands full.

I will try to pm name of bailiff i spoke to on friday now. thanks again.

I did have telephone recordings from Equita and The council

But i had a letter from there Solicitor asking me to remove them

Hi Lucy, I've done some digging around the forum to see what wiser heads have to say on the subject.

 

This thread has some good advice in, in the first page there's a suggested letter you can use to contact the council, you'll need to edit it to suit your situation.

Is it possible for you to head up to the council offices tomorrow even with kids in tow? And demand to see somebody high up. The council can take the debt back from the bailiff.

Thanks for all advise so far, but the problem is i have already let them enter, so they have all the rights now and i am at my wits end on what to do now. I can't think straight and am so stressed. All i want to do is pay this and to be able to sleep at night. I couldn't help being ill and missing a payment, and now with this added stress i am going to end up ill again.

It isn't over yet, you need to get in touch with the council and ask to speak to a revenue collector, tell them everything you've said in this thread, that you're a child minder, that you've been ill for several weeks and been unable to work, and because you were not working you had no income and were unable to make any payments. That you've been told to speak to the bailiffs but they won't listen to you because you're not able to make a full payment, and they're threatening to come round and seize your stuff some of which you need for your job as a child minder, and also if he comes when you have the children there it could potentially mean you lose your job.

 

Are you able to make a payment tomorrow? If so tell him you're willing to do that, and then make regular payments until the debt is paid off.

Thanks for advise, will phone council tomorrow, and hopfully get someone who will listen, when i rang on friday they did'nt want to know, said it was out of their hands. I have already made this weeks payment, and next weeks is due tomorrow, which i will make in the morning. I am not refusing to pay, i was just unable to pay for a few weeks.

It'll be interesting to see if they accept tomorrows payment.

 

You should also mention to the council that Rossendale has charged you £110 for one visit, I'm pretty sure they're not meant to charge more then £20.

 

I have to go to bed now, it's very late. I really hope things get sorted for you with the council tomorrow, keep asking them until you get to speak to somebody senior. Sending positive thoughts up north to you.

No sleep again last night, very stressed today, contacted council they will not interveen. Have tried making my payment online to rossendales and cannot get onto their website, have been trying for 2 hours, have always paid to them this way and never encountered this problem.
