I have received in the post a County Court Claim claim form.  This relates to MYJAR and issued by TM Legal relating to a payday loan issued 11/2017, subsequently they issued a default notice 09/2018. The debt isnt on any credit reports.  4/4/2024 I had an email saying a Letter of claim was sent - this was not received , i replied to say I believed the debt was statue barred their response We are aware that the correspondence you have sent, is in a format that is circulated on consumer-based websites whereby debtors are encouraged to use the templates in order to avoid repayment of their debts. We do not accept that the contents of these templates bear any particular relevance to your case. For clarification, in line with the Limitations Act 1908, no claim may be brough after a period of 6 years from the cause of action. The cause of action in this instance is the Notice of Default served upon you by the original creditor on 24th September 2018. As such, the account is not Statute Barred. 10th June 2024 I have received a county court claim form and now i am unsure what to do next and how to complete and respond, I do not want a CCJ. Please help

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi everyone,

 

been nervously reading around this site for a few weeks after hearing how we are legally entiled to our charges back- so i have come to join in!

I sent the template Data Protection Subject Acess Request Letter off, with a chque- i had to borrow from my mom as i have now been cut off with all facilities! - its a graduate - well i should say was 1 a graduate account...am lucky enough to have the best mom ever and she has lent me the whole amount to pay back overdraft and loan they demanded back form me- which i think they could obviousley see i did not have. Just waiting now for repsonse from letter sent last Tuesday.

Opened up parachute account- like everyone advised here- Barclays- but can only have cash card. No hope of a mortgage just yet then!

will keep you all informed.

Bit scared....and worried, but hopefully youll all help me out with next steps!

Got my letter last night- reply about the statements! and recieved my cheque back! their doing it for free! ...anyway- now just waiting for statements- ive asked for 8 years worth- the whole time ive had the account? - i have been reading that its mostly from six years- is there a right or wrong certain length of time to ask charges back from??

 

I reckon im going to have opile to sort through! ...yet loads of repayment in charges- and some donation money for this site!!! ...i would never have known what, where and how to even start without this site and everyone in it! Thank you!

The letters made me quite excited now! ...the bank deserve it their so rude to me- one day ill be their best customer!!!

As far as I am aware you can only claim 6 years worth of charges, I am sure someone with a bit more knowledge on the subject can confirm this.

 

I just posted by initial letter today so we are on the same timetable roughly, be interesting to see the different timescales involved.

In all the reading that ive done on this site- it seems that everyone has claimed up to six years and no more- not a problem- i will just probably recive more statements- but just add up six year charges.

 

Will let you know when i get my statements!!! - im sure it will take a while to recieve the whole lot (poor postman)!

Thought so...just from reading on the site- but thank you very ,uch for confirming maverick.

Recieved the first 3 years of statements last night- niot as many charges as expected- not as bad as i thought i was- but i will still be claiming! £300.

perhaps the previous years might contain more charges, although i found that it wasnt as much, because the actual charges themselves were less back then

I hevent posted anything for a while- becuase im still waiting all my staements- had loads coming daily at one point...and now nothing- think im going to have to contact them- kind of them to waver the fee for the stements- but i think they purposeley 'lose' some in the post! ...my charges so far arent half as much as i thought theyd be- i did used to argue the chrages as they added them on- and alot of the time- i did find some nice ones that naughtily wavered them for me- the trick was i used to take down their name and then kept askign for the same person- it seems to kind of flatter them and they start taking much better care of you!! ...try it! .......still claiming my charges anyway- im going to contact them and get the rest of my statements.

 

sorry extremely long post here but...just wondering if anyones seen how much is in the papers at the mo on refunding unlawful bank charges? and the man living in wales whos helped loads of people for free! ....also how now courts are throwing out the cases as they know that the banks will not win- but do you think this will work against the whole process? although the more people claim them- surely the less the banks are likely to charge- unless they start targeting the really culnerable who they know wont claim, like the eldrely who ofetn will not kno the first step to claiming them back.
