7yrs ago i took out a loan with a friend in the house we shared since then i have left and my friend said they would pay the debt (not )the trouble is now i have no fixed abode and i cant work so im on benefits now and debt agencies are harrassing my parents for the debt, so how can i go about sorting this out when i dont have an address.

 

plese help

 

p.s i dont know how they got my parents address in the first place as the debt was taking out at another address

Hi there,

 

If it was 7 years ago, under the statute of limitations act they cannot pursue you.

If it is that old, then they cannot do anything. If you are sure it 7 years, then write and tell them it is past the 6 years and under the statute above you do not have to repay the debt.

i know its 7yrs since i last payed any of the loan back but i dont know when the last payment was made by my friend as we have lost all contact with each other so would i beable to still use that act for myself

Hi buffy

 

First, can you tell us what kind of loan this was? Second, if CJ says, if it is more than 6 years in England (5 in Scotland), and the debt has not been acknowledged then it may well be statute barred. This does not mean that the debt does not exist, but it does mean that it is not enforceable through the courts.

it was a personel loan with paragon but now my family is getting letters from a company called arrow and cbs and also my friends are getting letters with my name on them because i have no fixed abode so they cant find me so there sending letters to my friends and family wich i think is unfair as its not got anything to do with there addresses or people

Catch22 - you need to CCA and S.A.R - (Subject Access Request) them which will give you the statements you need to show it is statute barred. But, that will give them your new address which you'll also have to give them to threaten them with OFT guidelines on debt collection that they're breaching.

 

If Paragon have hawked this round two DCA's then I reckon it isn't kosher.

 

I'd write from your own address (or c/o a friend who doesn't mind the crap that will come with contact) and ask for the evidence they need to provide to establish the debt.
