    • Its okay - It happens. And this is why DCAs  user every trick in the book to try and make you crack.  Now its time to come back.    Im not sure how to proceed if Im honest if they have issued a Letter Of Claim.  Only as You could complain to Oakbrook and they still proceed with Legal Proceedings, but I dont know if that would help or hinder the legal proceedings if they began down that avenue.  I know a FOS complaint wouldnt stop Legal Action and probably run along side it.  But I guess a judge would view a disputed balance with the original creditor as cause for concern whether the DCA's claim is valid?    A bit of a muddle.

Iceland have always been useless, not only in your case but in others, but I think if they realise they are breaking the law it will encourage them to act. I also think the letter is overlong and you could lose the paragraph - I cannot afford any unfair charges of this kind as I am severely struggling financially. I cannot work and am a carer for my disabled Son who also has a mental and mobility disability. I obviously do not have any disposable income and am in debt with my bills. So its an absolute impossibility for me to pay this incorrect charge - as the main points are made elsewhere.

    • I want to add my 2 cents here...  The purchase of this debt, Perch Group dont absolve themselves of liabilities from the Original Creditor. They should be responsible for dealing with this complaint in response to an Irresponsible Lending dispute.  If the balance is disputed as such in that way - Then they should be referring to the Original Creditor where applicable.    Also if your complaint was written in a way where a template wasnt used or it was rewritten to a similar effect where it wasnt recognisable - Then you probably would have stood a better opportunity at it not getting rebuffed.  To be honest those - Perch and TM Legal are a waste of Oxygen and will say anything to get you to pay.    Ditto on the template. Where did you find it?  Please keep in mind we have to unravel what you have done till now and help build a formal response.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I think I might off sent the prem letter to the wrong address, I havent heard anything from them, ( or is this their way of dealing with it ) Can someone confirm the following is the correct address please.

Thats the address I used and also the one for Paul Sherwood.

 

I does seem to be a deliberate tactic to "Play dead". just ignore the ploy and go through the process its very frustrating but worth it in the end.

 

I actually issued a warrant 48 hours before Forthright paid up, they have also sent me a cheque for £55 to cover the court fees for that as well

Received my sod off letter this morning, they even enclosed a copy of the aggreemant to show how I signed to say I would incur costs should I not keep up the payments, and the letter also says the following,

 

I note the referance to the OFT in your letter, may I point out their report and the subsequent media attention given to unlawful charges applied by banks to accounts, refers only to credit cards and not personnel loans, I am sure that in the future charges applied to personnel loans will be put under scrutiny, but at this time there is no threshold deemed unfair for default charges applied to loans.

 

Money claim here I come.

Hi Brecken,

 

They have 14 days to enter their defence from that Date.

Crusty does seem to be right though. they do appear to play dumb untill somebody harrasses them.

I had to nudge them and they said trhat they had never recieved anything. Even today I am getting BS from them that the cheque has been posted. Unfortunately I cannot afford the bailiff fee untill the end of the month so am still trying the threatening game.

Personally though you should hope that they do file a defence as I think that they will have no legs left to stand on if it ever went to court. Just to reassure you though, If it did go to court I would come up to you and support you, I am only in Cheshire.. Anyway forget it now for the next week, then ring the court to see if they have filed. Bet you they dont.

That means they have to file a defence today, and if they dont I can enter judgment is that right ?

 

Thanks for your offer of coming to court with me, that would be brilliant, although hopefully they will pay up before then.

Good NEWS.

 

Recieved My cheque today for the full amount.

Much as it would be nice to meet, hopefully under different circumstances.

Check with the court though and see if any defence has been filed. If none has then you just have to wait for the court to pull their fingers out.

I have just checked on money claim and it says I can enter judgment does this mean they havent entered their defence ?

I have just had a call from a lady called karen, she as told me a cheque as been raised today 20th Nov, their defence was due tomorrow, but she said they didnt want to go down that route, so they are paying up, Im not holding my breath until that cheque is in my hand. she also said they prefer clients to talk over their issue with them rather than go down the court route.

Why then do they send sod off letters and make people take them to court.

Anyway I will keep you informed and I will make a donation as soon as cheque received and cashed.

Judegment entered, 25/11/06. I have requested payment in full by 1/12/06, what do I do then if I havent recieved my money, Forthright are still insisting they have sent the cheque by the way.

I was a bit confused also, it turns out the company Im dealing with is capital bank, a subsid of forthright,

Just about to phone the woman who told me my cheque was in the post.

will keep you informed.

 

Just got off phone, she told me she has put a stop to the 1st cheque cos it has gone astray and a new one will be sent out this week.

Come friday the baliffs will be sent in if I havent recieved it.

Yea somewhere down the line Capital Bank sent me a letter as well, I swear these people (finax,forthright,capital bank) all sit in the same fooking office eating malteasers and farting together !!!

Seems the 'gone astray' thing is just time wasting, like you say give them 2/3 postal days and send in the dogs.

I would suggest that if your money has not arrived be very forceful and suggest a money transfer direct to your bank account. At the same time tell them that You have got THE JUDGEMENT against them, you are not the first and will not be the last so failure to pay NOW will result in the bailliffs being sent and the loss of yet another days earnings as time is needed off to attend to things. This attitude did work for me and I received the Cheque within a couple of days.

I sent the bailiffs in to Forthright, as soon as the case was referred to Chester for collection they paid plus the court fees for collection.

One interesting fact; according to the bailiffs they are not actually at the Chester address ???

Still no cheque, phoned again today has I will everyday until I receive my cheque, thankfully I have the direct number for the person that told me origionaly that the cheque was on its way.

she is still insisting that the cheque has been sent.

Will wait until friday then will send in baliffs.

I received the notice of judgement entered today.

Phoned again on thursday, told her I had spoken to 2 other people who had dealings with them and had been given the same run around, she said she was sorry about all the mix up and would have my money paid directly into my bank account, same day transfer, well no money appeared on thursday, I recived a phone call on Friday from her and she said I have just recived your cheque on my desk this morning saying undelivered I cant imagine how this has happened, do you want me to send it now for you, I told her no I want you to pay it into my account like you said you would yesterday, Oh right she said thats what I will do then I will do that today for you.

Guess What no money in my account.

If it isnt there on Monday the Baliffs are going in.
