    • Thanks, I've had my fill of this lot. What makes me so mad is that I had to take out student loan to get any DHSS help. And then when I tried to help myself and family they presented obstacles. Might be worth passing story to RIP off Britain?
    • there is NO exposure if you simple remove your name address/ref numbers etc from docs, over 10'000 pdf uploads are here. which then harvests IP addresses off of the people that then do so..which is why we do not allow hosting sites. read our rules and upload carefully thats exactly why we say capture as JPG, redact, then convert/merge to one mass PDF. then online sites to achieve that we list do not leave watermarks.  every once in a while we have a user like you that thinks they know better...we've been doing it since 2006 with not one security issue. thank you.

    • no they never allow the age related get out, erudio are masters at faking supposed 'arrears' fees which were levied before said date and thus null its write off. 1000's of threads here on them!! scammers untied that lot. i can almost guarantee they'll state it's not SB'd too re above, but just ignore them once sent. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I need some help on this one please.

 

I signed up for 0845 services for my own business in Feb 2007. On there website there is no mention of minimum terms of service, or contractual obligations until you are signing up where they have a T&Cs which you have to agree to before signing up.

 

Anyway, I've now cancelled the service and they have sent me a bill (I've being paying monthly so account is up to date) up until Feb 08. I'm trying to dormant my ltd until I know what I'm doing, but this is going to be really expensive.

 

I did email them to say that these minimum periods are not stated clearly on their website at all - and imply that services are monthly.

 

They have emailed back to say that the T&Cs clearly state that the minimum service is 12 months.

 

I have never received a copy of these T&Cs, they are just made available upon the sign up stage via their website.

 

Can any one help me out here? I feel like I'm being done over here.

 

I have a link for the T&Cs, which I can see it mentions minimum terms, but the T&Cs are awfully generic and I wonder if there is a way I can circumvent this ridiculous charging for service I won't be receiving!

Yes it is a [edited], they did the same with me and took over £100 from my account and didn't even tell me till after they had done it. Stay away from these [edited] or find your accounts being debited without your permission.

Hang on... they HAVE your permission! That's what giving them a Direct Debit is all about. They may never have told you the amount before taking it, which is a technical naughty, but there's no issues over their right to take it.

 

If they didn't have permission, they wouldn't know which account number to take it from.

Companies have T's & C's to give you all the information you need. It's not their fault that you can't be bothered to read them. If you ordered on line I would imagine that you had to agree to the T's & C's before completing your order. I can't see that their website is misleading, it doesn't say there isn't a minimum contract period. You have no argument.

Yes that what they do, they let you sign up for a free service and a year later send you an invoice for a whopping renewal fee.

 

When they do this they refer to T & C's on their website that are were not there when you signed up.

 

They have sent me debt collection letters via "Credit Debt and Legal"chaising for a renewal fee and a 60 pound disconnection fee for an 0870 number that I never actually received after tryin to sign up for the free service.

 

BTW where other people have written the same online you will often see many negative responses which I believe are from the director of the company
