  1. Thanks to you both, I will wait a bit longer. Are you going to appeal midge61?
  2. I have recently wrote to the VOA requesting that they look at my case as I definately believe I am in the wrong band. I haven't heard back and it was about 2 weeks ago. What is the timescale usually of them acknowledging your query? does anyone know
  3. most mortgage companies will refund the difference between the exit fee quoted at the time of application and the fee you actually paid when you redeemed your mortgage.
  4. Not sure if many people have tried claiming back exit fees yet since the FSA announcement but if you have ever had a Halifax mortgage call 08457 273747 the press option 3 then 2 which is the option dedicated to exit fees (obviously expecting a high demand) . They tell you what the fee was when you took out the mortgage and what it was when you redeemed they then refund you the difference via a cheque within 28 days. I know its a drop in the ocean compared to erc's but better in our pockets than theirs. I have just claimed mine from 2000
  5. Thanks for your advice I will give it go, I feel I have a strong case because the house is in band C and that meant it had to be worth at least 52,000 in 1991 and I bought it in 1997 for 48,000 so I feel sure it should be in band B
  6. Martinhw I would buy the beers if you can get me five years of overpaid council tax back?
  7. Hi Marcelle Thanks for the message, I lived in the proprty for 5 years but I currently rent it out to someone else but I am still the owner so can I not query the banding? or does it have to be the tenant? Cheers
  8. I just wondered if anyone knew where I stand with querying incorrect council tax banding on a house I rent out? I lived in the property for 5 years and since then I have rented it out. I believe the banding has been incorrect the whole time so I should be inline to recieve some money back but I don't know if I can query it because although I am the owner I no longer pay the council tax bills Help please?
  9. you can claim late payment charges like you can with a bank and also a some people are successfully reclaiming the exit/deeds fee which is usually about £250.
  10. Recieved cheque today for FULL settlement, Thanks to everyone especially kazzaw
  11. They are offering you some money back from the "discharge of mortgage fee" because the FSA have intervened and say mortgage companies can't hike the cost up from what it was when you intially took the mortgage out. A lot of people are getting some money back for this fee or otherwise known as exit fee/deeds fee. I am not sure whether the "help with costs is technically a penalty" as its just a form of cashback mortgage.
  12. I am not really sure but I wouldn't have thought it was a penalty as such.
  13. I have a northern rock mortgage and the "help with costs" is a cashback deal on the mortgage but if redeem your mortgage early you are required to pay it back aswell as and ERC that may apply.
  14. If they don't defend (which I am sure they will) you win by default and you just need to apply for judgement. You are a bit further on than me, I have just sent prelim letter
  15. I didn't actually claim the interest just because my claim was a small amount. The have offered me the full amount + court costs and my account with them has a nil balance so I am not too worried about that.
  16. Filed my claim against egg with moneyclaim on 22nd and recieved a letter from egg yesterday saying 1.We view our terms and conditions as fair and in particular the charges levied pursuant to section 7.1 of your credit agreement with egg banking plc to be a genuine pre-estimate of loss rather than a penalty. 2. Notwithstanding our view, in the particular circumstances of your case we put forward the following settlement proposal: (a) Without any admission of liability and purely on a commercial and ex gratia basis we will within 14 days of your acceptance of this proposal by return of the signed consent order(see paragraph (b) below) pay you £xx in full and final setlement of the proceedings in Northampton County Court under claim number xxxxxx and of all claims, rights, actions and causes of action (including claims for interest and costs) you may have against egg arising out of or in connection with any issue pleaded in this case. (b) As your acceptance of the proposal you will sign and return to us the consent order enclosed with this letter providing for dismissal of the proceedings on basis of each party bearing their own costs. Once we have recieved the signed consent order we will lodge it at the court to bring proceedings to an end. They are offering to pay me back in full so should I just return the signed form? and do I need to do anything with moneyclaim?
  17. I would report them to the information commissioner for breaching the data protection act.
  18. Hiya I posted my request for statements and £10 on the 6th december, the cheque was cashed straight away and a letter sent acknowledging my request. As yet no statements and they have until this tuesday to comply..
  19. Try looking under other institutions and then mortgage companies, it mentions quite a bit about early redemption fees
  20. 06.12.06 sent S.A.R request with cheque for £10, the cheque was cashed straight away but as yet I have recieved nothing. Its another 5 days until their time is up but I was wondering has anyone else had a similar experience with the yorkshire bank?
  21. Thanks for that, I will file a claim at the weekend
