if you gave them 14 days and the 14 days is now up - I would send the Letter Before Action, which is the next step in the process. -

Has anyone failed to get a response from a DPA request and subsequently sent a prelim letter estimating their charges? I have had no response to my initial letter or my chase emails to the Halifax - i can only go back 12 months on my online statements so I therefore don't know how much I have been charged for previous years. I don't want them to get away with the previous years but other than estimating their charges, I don't know what to do if I don't have statements or a list of charges from them. Advice please! -

As I have still not had an acknowledgement of my DPA request sent by recorded delivery (and signed for at Trinity Road, Halifax on 3rd March) I have today sent a reminder email to the Halifax, advising that they have 25 days left to comply with my request. I also re-iterated my request that they debit the £10 charge from my account and asked them to confirm receipt of my reminder. Not holding my breath that they will do any of this, but if they don't I will complain to the IC. However, if I don't get a response I can only go back 12 months on my online statements with the Halifax so will I have to estimate my charges and amend the letter to say "I estimate that you have taken £xxxx from my account......" and hope that that brings a response from them? -
If you get to go to court I'll come with you for moral support - I am quite near you...

14 days and counting today - Halifax haven't even acknowledged my request although it was delivered by Recorded delivery...

you only add the 8% when you make your claim through the court. I think it is covered in the FAQ's but haven't got that far myself yet!

If that is the template letter from the library then I am sure it is fine..many people have used it successfully... -
Either Nationwide are very up on their DPA requirements or they are getting a lot of requests for 6 years worth of statements! On their online banking page for ordering duplicate statements there is a standard information line which states that they can provide statements for 6 years.

Further online message received from Nationwide: Dear Ms Ripped-Off, Thank you for your message. I have confirmed with our Data Protection Officer that the reason we advise Members to visit their branch is for confirmation of their signature, as required by the Data Protection legislation. They advised me that if asked them they would need write to you to advise you of this as well and to reply by letter with your signature.. They confirmed that you are welcome to write a letter directly to them, including your original signature to the Team for disclosure under the Data Protection Act at the following address: Nationwide Building Society Data Protection Team Kings Park Road Moulton Park Northampton NN3 6NW They also asked me to say Nationwide routinely do not charge and waive the permitted fees for this service. In addition if you would also like any or all FlexAccount statements you can request copies of these at any time on their own, online as follows: Select the account you wish to work with and select the option 'Other Services'. Click on the option 'Duplicate Statement' and complete and send the form. If you would also like statements for other savings accounts, please let me know the account numbers and the dates required. For any credit card statements please contact Nationwide Credit Card Services on 08457 998899 and a credit card advisor will be happy to help. Regards, Jim Cruttenden Nationwide Direct Will now send a copy letter to the DPA team, but good news that they don't charge you and that you can order your duplicate statements online if you have online banking.

So would it follow that if you authorised them to debit your account rather than send a cheque, that they are deemed to have received the money at the same time they receive the letter (whether or not they bother to take it from your account)?

Having received the response above on 2nd March saying that they would respond within 48 hours I have heard nothing more. I have not even had an acknowledgement of the copy I sent by recorded delivery (although I do know it was delivered). Oh well clock is ticking as they say..... -

I can understand that being a student money is tight but think of it this way - the £30 is less than the cost of the charge for one returned DD from these thieving banks!
