  1. Hang on...how come they don't know....?? apparently they have 2 members of staff doing this every time a DD is returned!!!! We really are dealing with a load of idiots in these banks.... next they will be asking us what the DPA is!! I would send him a polite note back and tell him he should find out from the Information Commissioner! On the other hand if they had the brains to look up "manual" and "intervention" in the dictionary it would probably give them a good idea!
  2. Has anyone considered bringing the question of unlawful bank charges to the attention of BBC Watchdog? Might be a very good way to spread the word and make people more aware.
  3. what would you do if I stole money from your account? - Right - you would go to the police - if there is nothing in the T&C's that said they could do this that is exactly where I would start, then on the the press etc etc etc Let's get all the facts first.
  4. Good for you The more and more this happens the more and more they are going to look like what they are - pathetic... they spout on about how their charges are fair and yet if they really believed that they would stand up in court, just once, and prove it to us all!

  7. Hmm seems to me that SOMEHOW (and I haven't got an answer to how!) we have to get them to confirm that there were no manual interventions. Maybe a follow-up letter to a DPA response could say ..."thank you very much....however you have not confirmed, as requested in my letter that there were no manual interventions. In the absence of any being listed (and the requirement of the DPA that any manual intervention should be??) I will proceed on the basis that you agree that there have been none, should I not hear to the contrary from you within 7 days...... Thoughts anyone?
  8. Did they actually confirm that there were no manual interventions as you asked them to in your letter? or were there just none listed? If there were none listed and you have had some DD's (or other transactions) refused doesn't this prove that what Ian Mullen said about 2 people having to manually intervene in transactions was untrue? Could you use this as a defence in court along with the transcript of his interview?

  12. I found this in the FAQ which would suggest that statements are part of the file and covered by the DPA Q. The trouble is that I don't remember what they have taken from me. I'm not very good with my paper and I don't have my statements any more OR I was troubled about ID theft and I shred my statments after looking at them and therefore do not know the amount I have been charged, how can I find this information? A. You can apply to your bank for copy statements going over as long as you need. You can make an offical request under the Data Protection Act (1998) - you need to make the bank aware that you are making this request under the DPA. They then have 40 days to comply with the law. If they state that bank statements are not covered under the act, point them at the Durant v FSA case, in which the judge ruled that bank statement information is 'personal' information and thus covered under the Data Protection Act.
  13. I think Bankfodder is probably trying to find out where the contract was taken out. i.e. England or Scotland. The answer to your particular question may very much depend on this.
  14. Stephen have you got your court date yet for your "big" one?? Could we not all come to court and support you (outside of course I am sure we would never fit 6,000 of us inside!) I for one would be happy to take a day off to do this

  18. yes they can, and they can charge you a maximum of £10 for a DPA request.

  20. yes, because you need to get details of ALL transactions on your account - including any manual interventions. The banks may try to defend their charges by saying that manual intervention is required to refuse a DD or other payment from your account, so if you can get confirmation from them that there were no manual interventions then this blows that argument apart...
  21. Just had a msql error come up (which i didn't manage to copy ) when trying to respond to a post but it said something along the lines of there are 48 people logged in consequently I am having to work too hard :? (do you think I will ever get an IT specialist job??)
  22. I wonder if that is a recent thing?? No doubt all the other banks will have to follow soon as more and more people are made aware of the banks practice of unlawful charging
