  4. My case is a little unusual so please bear with me. I'm in an IVA and am in the process of claiming back my charges from credit cards that have been defaulted and passed on to DCAs. Despite my consistent request for refunds to be paid by cheque MBNA have "credited my account at the DCA" for 'nearly' the full amount. This is useless to me as I am paying a set amount towards my creditors in my IVA and any additional credit to one DCA makes no difference to my repayment. It's also a payment favouring one creditor over all the others which is technically a breach of the terms and conditions of the IVA. Can they do this? Can I insist in the refund of charges to be paid by the method I choose? Would appreciate help in this matter. Thanks
  5. Aha! Thanks very much for this advice. I thought I could claim 8% on every charge since the charge was made! ie I had some charges where I was trying to add interest for over 2000 days (nearly 6 years). I take it that I can't do this?
  6. Well, I sent my LBA and it's now a little past the 14 days I gave them to offer me a full settlement. I will give it another day or two before filing my claim @ money claim online. I assume I am now entitled to charge interest of 8% on top of my claim? Using the 'simple' version of the template in the library this pushes my claim from around £800 to around £1000. Does this seem about right? Any help much appreciated as I dont want to do anything wrong at this late stage. thanks
  7. Jon, re your signature, why are you trying to recover bank statements of an account that was closed in 2000? The statute of limitations means you cannot recover fees etc that are more than 6 years old.

  9. Hi Guys! I received a letter today offering me a settlement figure of £147 which is apparently the difference between the recommendation charge of £12 and what I was actually charged. My total charges amount to £447. What should I do next?

  11. Be careful. I've read that when the paperwork is applied correctly by the sales assistant (which doesnt always happen) a cancellation of the warrantee results in the discount being claimed back by the retailer.
  12. Bear in mind although it could arguably be PC World's responsibility by law, in reality it's the manufacturer's 'fault', so why not try them first?
  13. Thanks Redsue. I've already got copies of my statements and have sent a list detailing the charges I am claiming back. Received the standard 'holding' letter today (bang on 14 days) saying they'll send me a full response by 23rd. Looking forward to the fight!
  14. Guys, you aint gonna get any judge find in favour of you as it's not a creditable offer. Also where did you get the code from? The majority of discount codes on the internet are obtained illegally which could leave you open to a fraud challenge!
  15. The Tomtom ONE doesnt come with maps on the CD anyway. I know that the law deems the retailer responsible but in reality it's the manufacturer's fault and they're also in a better position to resolve things like this. A call to Tomtom would have been much more likely to resolve this issue and in a faster time.
